憲法は国の最高法規であるため、憲法に違反する法律や命令はすべて無効となります（日本国憲法第98条）。裁判所が違憲判決を下すことで、その法律は効力を失うか、国会による改正を余儀なくされます。

違憲審査権は憲法81条で最高裁に与えられた「憲法の番人」としての大事な役割です。

先人たちが三権分立を守るために用意してくれた宝物なのに、日本ではほとんど行使されないままなんですよね。

アメリカでは司法審査が活発で法律を無効にした例が山ほどありますが、日本は付随的審査という仕組みに加え、裁判所が控えめな姿勢を取ることが多いんです。
