We are deeply concerned that the end result of the USCIS’s new proposal will be more instability and chaos for families, businesses, and communities.
Americans have 60 days to express their opposition to this proposed rule.
Instead of working to create a more functional immigration system, the Trump admin is doing everything possible to cut off the avenues that exist for people to come to the US lawfully, maintain a status while here, and to feed themselves and their families throughout the process.
Finally, the admin is proposing to require any person seeking to renew work permits on the basis of parole, deferred action, or an order of supervision show that they were working for an employer that uses E-Verify — even though fewer than 1 in 5 of all employers use the system.
The Trump admin is also proposing to limit many work permits to just one year before renewal, impacting people seeking green cards through marriage to a US citizen, spouses of H-1B visa holders, asylum seekers, and more.
The result could be extra costs and worsening backlogs.
The proposed rule would also limit access to work permits for people granted humanitarian parole or deferred action (excluding DACA), and restrict work permits for people who don't qualify for asylum but are granted legal protections barring deportation to their home country.
NEW: On Friday the Trump admin announced a proposed work permit regulation that could make it dramatically more difficult for many immigrants in the US to work to support themselves and their families, including DACA recipients, asylum seekers, and the spouses of skilled workers.

🚨 Oh shit, I missed this one yesterday! DHS has posted a notice of proposed rule to further limits immigration discretionary benefits and to finacially squeeze non-citizens seeking to legalize their status in the hope that they will just leave. The new abomination proposes to:
*amend its EAD (work permit) rules for applicants seeking to get or renew their work permits if the application is based on parole, deferred action **other than DACA**, OSUP, or have any criminal record;
* non-citizens seeking EADs in these category would be required to establish economic need and that they warrant favorable exercise of discretion;
* add automatic termination conditions for employment authorization with triggering events;
* for renewals applicantions, the applicant will have to show that they are employed by or seeking employment with an employer who participates in e-Verify;
* basically eliminate EAD eligibility for any one who has been arrested, indicted, or convicted of any criminal act (LRA language creeping into other provisions), or who have admitted to committing a violent or dangerous crime, or for whom evidence exists that the applicant is a member of a gang or terrorist organization by pro do not warrant a favorable exercise of discretion, unless there are significant countervailing publclaiming that such applicant do not merit favorable exercise of discretion unless "there are significant countervailing public interests", almost impossible to reach standard.
Comments are due 8-4-2026. So likely we may get this as a final rule early next year. Major, major!
