Delaware Judge Orders Fox Corp. to Dump Hundreds of Files on Murdoch, Deleted Texts, Phone Hacking, and the Dominion Settlement In Massive Shareholder Lawsuit | Jim Hoft, The Gateway Pundit

A Delaware judge has just ordered Fox Corporation to hand over a mountain of internal records in a long-running shareholder lawsuit aimed at Rupert Murdoch, his son Lachlan, and other Fox directors. The files cover phone hacking, board minutes, emails, and the deletion of Rupert Murdoch’s text messages.

The order landed last week from Vice Chancellor Bonnie David. Fox fought to keep the material sealed. The judge sided with the plaintiffs across the board.

According to NPR, the haul includes roughly 700 documents that mention “phone hacking,” years of Fox board meeting minutes, emails from former Ford CEO and longtime Fox director Jacques Nasser’s Ford accounts, and a list of every email address ever used by Nasser or Rupert Murdoch.

Shareholders’ lawyers will also get sealed records from the still-pending Smartmatic case that deal with what the court calls Murdoch’s “spoliation” of records, legal speak for wiping texts.

The case was filed about three years ago by five New York City public-employee pension funds and Oregon’s public employee retirement system.

Those are Democrat-run, taxpayer-backed institutions using Delaware corporate law to try to pin Fox’s legal bills on the Murdochs personally.

The Associated Press reported earlier that the same funds accuse Murdoch and other Fox leaders of ignoring “red flags” after 2020.

The lawsuit was lit by Fox’s nearly $787.5 million settlement with Dominion Voting Systems in April 2023, one of the largest defamation payouts in American history. Smartmatic is still suing and wants $2.7 billion.

The Gateway Pundit said at the time that Fox rolled over. Joe Hoft wrote that the mainstream media was “giddy” and that Fox “gave the MSM everything they ever wanted.”

Harvard law professor Alan Dershowitz told The Gateway Pundit the Dominion deal “never should have happened” and that “something else had to have been involved.”

Bill O’Reilly said the same week that Rupert Murdoch settled because he did not want to take the stand. “He told his lawyers settle it,” O’Reilly said.

Now those same settlement dollars are being used as the launch pad for this derivative suit. The pension funds want the Murdochs and other directors to personally eat the loss.

Seth Rich Is Back in the File

The complaint also points to Fox’s retracted 2017 reporting on murdered DNC staffer Seth Rich and what plaintiffs call an undisclosed settlement with the Rich family. Fox published, then yanked, a story suggesting Rich may have leaked Democratic emails to WikiLeaks.

The Gateway Pundit has covered the Rich case for years. In 2018 we reported that a federal judge dismissed the Rich parents’ lawsuit against Fox News.

This summer TGP reported attorney Ty Clevenger’s claim that the FBI had stashed hundreds of Seth Rich pages in a previously hidden SCIF room at headquarters, mixed with burn bags.

The Left treated any question about Rich as forbidden. Fox folded the story. The pension-fund lawyers now want to use that episode as proof the board ran a “scandal business model.”

Phone Hacking and Wiped Texts

The British phone-hacking scandal at News Corp. titles more than a decade ago has already cost that side of the Murdoch empire an estimated $1.5 billion, according to NPR.

Fox Corp. was split off from News Corp. after that mess. Plaintiffs want the “phone hacking” paper trail anyway, plus board records from Fox and related companies.

Then there are the texts.

Fox’s own lawyer, Anitha Reddy, told the Delaware court that claims of wholesale deletion are “incorrect,” but she admitted “there was a period … when text messages were not retained.”

Court argument, as reported by NPR, is that Rupert Murdoch auto-deleted texts until about April 2022, after Dominion had already sued.

Shareholders now get the sealed Smartmatic file on that spoliation fight. Fox, for its part, has accused Dominion and Smartmatic executives of destroying evidence too and asked for sanctions.

During the Dominion case, Dominion’s lawyers also accused several Fox personalities and executives of failing to preserve texts and emails. NPR notes that list included Pete Hegseth, now serving as Secretary of War.

The entire case may turn on one man: Jacques Nasser.

Nasser, the former Ford chief, sat for more than two decades on Murdoch boards at News Corp., 21st Century Fox, and Fox Corp., including as lead independent director until 2023.

Plaintiffs say he was never truly independent, that he backed the family through the UK hacking crisis, a BSkyB stock buyback that increased Murdoch clout, and the selection of other directors. If a judge later finds Nasser was not independent of Rupert Murdoch, plaintiffs argue more than half the Fox board fails Delaware’s independence test and the case can go to trial.

Vice Chancellor J. Travis Laster already refused to throw the suit out in December 2024. David’s new order is the discovery hammer.

- Special access to a particular reporter is not a First Amendment violation.
- “That is true whether or not such an invitation is based on viewpoint.”

So which is it, WHCA?

When the club locks the conservative out, it’s “safety.”
When the White House locks the network out, it’s the death of the Republic.

Over the past few days I have heard a number of very sober, well-reasoned commentators on the political right talking about the midterms and related polling.

They uniformly speak about the House already being a lost cause for the GOP, and they focus on whether the GOP can hold the Senate.

Things do not need to be this way. Trump won in 2024 by large margins. The only reason that cannot be repeated this fall is if YOU—the average Trump voter—decides to let it happen.

I know, I know, I know. Trump has not made all of your hopes and dreams come true in two years’ time. You think he has done nothing, even though he has had profound victory after profound victory in areas like immigration and downsizing the federal government. You have your pet issue that has not been satisfied to the extent you demand, so you want to “Stay home and send them a message.”

Yes the GOP sucks. It’s a heinous mess of self-interest and failed status quo maintenance.

But the only thing worse is the Democrat Party.

We are running against LITERAL COMMUNISTS who want to abolish the Senate, pack the Supreme Court, add two new deep blue states, open the borders to unlimited immigration and succumb to creeping Sharia and jihad in order to literally destroy the nation. (Plus, they will spend the next two years impeaching Trump and everyone in his orbit, fully defeating what you voted for in 2024.)

So you have two choices. It’s a binary choice, there is no third option:

1. Vote for doing everything we can to pursue MAGA even if that’s not perfect.

2. Stay home and become ruled by literal Communists who want you dead.

Choose.

We can still win this fall, we just need the will to do it.

On this morning 250 years ago, the British hanged a 21-year-old American schoolteacher as a spy, and in trying to make him disappear quietly, they accidentally made him immortal. His name was Nathan Hale, and it is worth sitting with just the last few hours of his life.

He had been caught the night before, behind British lines on Long Island, carrying notes on enemy positions hidden in his shoes. There was no real trial. A man out of uniform with military intelligence on him was a spy by the rules of war, and the sentence for spying was death by hanging, no ceremony, no honor. General Howe ordered it done in the morning.

What we know of that morning comes mostly from the enemy, from British officers who were there, and it is the small human cruelties that stay with you. Hale asked for a clergyman to attend him in his final hours. The request was refused. He asked for a Bible. That too was denied. He was a devout young man about to die, and they would not give him even that comfort. A British officer named Montresor, watching, was troubled enough by the young man's composure to later make sure his story was told.

In his last moments Hale was allowed to write a couple of letters, one to his mother, one to a fellow officer. He wrote them, and then the British provost marshal, a notoriously brutal man named Cunningham, took those letters and destroyed them in front of him. The reason given was chilling in its pettiness: so that the rebels should not know they had a man in their ranks who could die with such firmness. They did not just want to kill him. They wanted to erase him.

Then they marched him to the gallows, and there, according to the accounts that survived, this young schoolteacher who had failed at the one dangerous mission he ever attempted, stood calmly and spoke about duty and country with a steadiness that unnerved the men sent to kill him. The famous words attributed to him, that he only regretted having but one life to lose for his country, may be polished or borrowed from a play he loved. But everyone who was there agreed on the essential truth beneath the wording: he met his death without flinching, and he made even his executioners remember him.

And that is the irony that redeems the whole sad morning. Cunningham burned the letters so no one would know how bravely Hale died. It did not work. The story got out anyway, carried by the very enemies who watched it, and a young man the British tried to erase became one of the most enduring symbols of the Revolution, honored two and a half centuries later, on this exact day, as the first American to die spying for his country. They denied him a Bible and a chaplain and burned his last words, and still they could not make him small.
