Agriculture does face genuine labor shortages, and a properly designed temporary worker program is not inherently “anti-American.” Expanding H-2A to year-round needs (dairy, livestock, etc.) could reduce illegal hiring if it stays strictly temporary, requires return, and doesn’t undercut American wages.
But the provision that lets current unauthorized farmworkers convert to H-2A status without leaving—while shielding the employers who hired them—is the poison pill. That’s not modernization. It’s a targeted amnesty that rewards past violations and signals that illegal presence + agricultural work eventually gets rewarded. Voters did not demand that.
Strip the grandfathering clause, enforce first, then expand clean legal channels. Anything less just perpetuates the same cycle.
