LEILA, CHEL SEEK PROBE INTO ALLEGED MISUSE OF FUNDS FOR HEALTH FACILITIES
House Deputy Minority Leader and ML Partylist Rep. Leila de Lima and House Assistant Minority Leader and Akbayan Partylist Rep. Chel Diokno have filed separate resolutions calling for a congressional inquiry into alleged irregularities and misuse of public funds in the construction and operation of public hospitals and health centers under the Department of Health's (DOH) Health Facilities Enhancement Program (HFEP).
De Lima, through House Resolution No. 353, urged the Committees on Good Government and Public Accountability, Public Accounts, and Health to investigate the "misuse and abuse of public funds" for the financing, construction, repair, and maintenance of public hospitals, super health centers, and similar facilities.
"May pondo para sa mga ospital at health centers, pero hindi naman nakukumpleto o hindi sadyang kinukumpleto; kung may maipatayo man, hindi naman operational at hinahayaang maging abandonado. Pagamutan yan para kanino—para sa mga multo?!" De Lima said, expressing frustration over what she described as widespread incompetence and waste of taxpayers' money.
She also decried the lack of medicines and expired drug supplies in public hospitals, stressing that billions of pesos continue to be wasted while many Filipinos struggle to access basic health care.
"Napakarami nating mga kababayan ang namamatay nang hindi nakapagpacheck-up o nakapagpa-ospital, napakarami nating nababaon sa utang dahil sa pagkakasakit at lalong nalulubog sa pangamba kung saan kukuha ng pambayad sa ospital, tapos malalaman natin na bilyon-bilyong pondo ang matagal nang nasasayang," she added.
Meanwhile, Diokno, through House Resolution No. 351, called on the Committee on Public Accounts, the Committee on Health, and other appropriate committees to look into the "nonfunctional and underutilized health centers" funded under the HFEP.
"Naghain tayo ng resolusyon para imbestigahan ang mga iregularidad sa DOH health centers. Aalamin natin kung saan napunta ang bilyon-bilyong pondo at bakit di pa rin gumagana ang karamihan sa mga ito," Diokno said.
Akbayan Partylist Reps. Perci Cendana and Dadah Ismula, and Dinagat Islands Rep. Kaka Bag-ao co-authored HR 351.
KIKO TO ANTI-SMUGGLING COUNCIL, BOC: WHY ARE SMUGGLERS UNTOUCHABLE?
Sen. Kiko Pangilinan questioned why big-time smugglers appear to be untouchable after learning that most agricultural smuggling cases have been dismissed due to insufficient evidence.
"Kung apat lang (na kaso) ang nafa-file sa court sa loob ng halos limang taon eh 'di untouchable itong mga smuggler," Pangilinan told officials of the Department of Justice (DOJ) and the Bureau of Customs (BOC) during the Senate Committee on Agriculture, Food, and Agrarian Reform's public hearing on Tuesday, October 7.
He pointed out that about half of the cases were dismissed for lack of documents from the BOC.
"Kung kulang ang dokumento galing sa BOC, anong agenda ng BOC?" he asked.
Citing DOJ data, Pangilinan said that out of 132 agricultural smuggling cases from 2021 to 2025, 74—or 56%—had been dismissed, 36 were filed with dismissal, 12 were archived or returned to the BOC, and only 4 were for filing.
"Maliwanag sa record na ito, meron talagang untouchable," he said. "Milyong-milyong piso halaga ang nakukumpiska taon-taon pero ni minsan walang nasasampahan ng non-bailable offense."
The senator referred to Republic Act No. 12022, or the Anti-Agricultural Economic Sabotage Act, which classifies the smuggling of agricultural products worth ₱10 million and above as a non-bailable offense.
"Kaya bakit tayo nagtataka na laganap pa rin ang smuggling? Wag na tayo magtaka," he added.
The DOJ explained that many cases were dismissed, archived, or returned due to missing or insufficient evidence from the BOC. Pangilinan criticized the poor case documentation, saying, "When you say return, walang sapat na supporting documents or kung may documents hindi original? So, parang gusto nila ma-dismiss yung kaso. Any lawyer would know (that) you cannot submit Xerox copies of documents and hope to present it in court."
Pangilinan stressed that the government's anti-smuggling campaign depends not only on enforcement but also on the quality of the cases filed. He directed the BOC and DOJ to submit the names of lawyers and personnel involved in building these cases, emphasizing that accountability starts with those responsible for evidence handling.
"Pag wala kayong documentary evidence, wala kayong conviction, dismiss ang kaso," he said.
In his opening statement, Pangilinan vowed to pursue both the big-time smugglers and the officials protecting them.
"Sila ang nararapat at dapat habulin—hindi itong maliliit na kinakasangkapan lamang. Walang hustisya dun. Ang mga pinuno ng sindikato, lalo na ang mga nasa gobyerno, sila ang dapat managot," he declared.
He said he had requested key documents from various agencies to trace the paper trail linking "dummy" consignees and brokers to the real players behind multi-million-peso smuggling operations.
Pangilinan also underscored the importance of swift justice.
"At tandaan natin — hindi sa bigat ng parusa nasusukat ang hustisya, kundi sa bilis at katiyakan ng pagpataw nito," he said. "Sapagkat ang parusang mabagal ay para na ring walang parusa. Ang batas, gaano man katindi, ay magiging walang saysay kung hindi ito agad ipinapatupad."
