@philmupp1 My son is off to Newtown High this year. Co Ed all the way and actually more girls than boys. I cannot be happier and I’m sure he will be too when he hits around year 9 or so!

Disregard detailed evidence and focus more on the legal and procedural elements of that body of evidence then apply it to fundamental rules in criminal law (such as burden of proof).

These cases are very difficult to prove and post RCIRCSA in Vic, there is plenty of legislative reform happening. The justices that find these flaws are opening them up to be corrected in a way that works with the system
@OpossumNicholas@el_duderino_2nd@sydneymediagirl I had a prof once say to me “there’s no right or wrong answer with the law otherwise we wouldn’t have dissenting judgements”. It’s so true. Even the court of appeal couldn’t agree. We have to accept the HCA judgement as is and rectify the law if needed moving forward
@el_duderino_2nd@OpossumNicholas@sydneymediagirl I think you should have a crack at reading the judgement. It’s an emotive case and highly complex but your questions are fair and you are probably capable of understanding the legal issues if you can view it objectively
@el_duderino_2nd@OpossumNicholas@sydneymediagirl It’s not to disregard the evidence provided by the witness, however, to maintain a purely legal view, the inconsistency was not challenged by the prosecution, leaving the standard of proof unfulfilled by the Crown which the jury should have entertained
