At first I thought the same thing. But then I thought about it and that wasn't what the ruling said. The ruling was if there was a referendum there's the risk that Alberta could secede from Canada without going through the process which is also something half of the separatists keep pushing. And in that case you have to go through the duty to consult prior to the referendum question and you have to insure protection for treaty rights before.
Like I said when the ruling first came out I thought exactly what you thought, and then I thought about it a little more.
