But what branch defines "offenses against the United States", and what branch adjudicates whether or not certain acts amount to punishable "offenses"? More recent jurisprudence has qualified the blanket power affirmed in the Garland decision, holding that executive clemency does not erase the fact of guilt outside of removing punishment. I don't necessarily agree with this and I hate to see any need to tool with this unitary executive check on legislative or judicial power, but the idea of pardoning any possible crimes committed from any possible set of facts or circumstances occurring during any portion of an extended time period as much as a decade or more, as Biden has done, is just the sort of abuse that cries out some sort of restrictive clarification, in the best interests of justice and to avoid a terrible precedent being set.

Moreover, to deem the power to Pardon such offenses so Broad and unrestricted as to be able to be issued in a blanket sense for any and all acts committed in any time period as has been done here by Biden, really guts any logical argument against the notion that a president could also issue pardons for all future acts which may constitute "offenses against the United States". There's a point at which reading the broadness of this power becomes absurd and opens the door to, if not actually incentivizes, wholesale abuse of the power that surely was never intended at the founding and should not be abided in present day without serious challenge.
