In country after country, opposition figures are arrested, prosecuted or threatened with treason charges after challenging those in power.

African governments must respect political freedoms, due process and the right of citizens to organise and challenge those who govern them.

When treason charges become a shortcut for dealing with political opponents, democracy itself is put on trial.

Jackson Mutyoka is a celebrated Special Forces instructor and Commando in the Zambia Army.

He rose to fame for his exceptional military skills demonstration in Mbala and achieved the highest rank for non-commissioned officers, Warrant Officer Class One (WOC1), before retiring honourably.

His Uncle, Patrick Musonda Wrote;

In the wake of information that has emerged and is now in the public domain regarding my nephew, Mr. Jackson Mutyoka, I wish to set the record straight.

Mr. Mutyoka honourably retired from the Zambia Army Special Forces in August last year after a distinguished and impeccable career as one of the country’s elite soldiers.

During his 20 years of service, Mr. Mutyoka rose through the ranks to become an instructor, attaining the rank of Warrant Officer Class One (WO1) at the time of his retirement.

The public may wish to know that Mr. Mutyoka transferred from Mbala to Lusaka on humanitarian grounds, where his expertise has played a significant role in helping manage the medical challenges of one of his brothers.

He is a family man who currently cares for his 85-year-old mother. Upon leaving the Zambia Army, Mr. Mutyoka established a security firm offering services within his area of professional expertise.

It is false, misleading and malicious to suggest that he and his colleagues are connected to foreign actors with the intention of committing such a grave crime as treason.

Those of us who know him are also aware that, not too long ago, his professional services were engaged by FAZ and its president, Mr. Keith Mweemba.

Mr. Mutyoka and his colleagues Bernard Chewe and Brasil Soko providing similar professional services to Mr. Brian Mundubile should neither constitute a crime against their country nor justify branding them a militia — an allegation far removed from the character and honour with which he served Zambia.

Our prayer is that Mr. Mutyoka’s case, and that of his colleagues, is processed expeditiously and with full respect for their constitutional and human rights.

Our jurisprudence is founded on the presumption that an accused person is innocent until proven guilty. Now that more than 48 hours have elapsed since Mr. Mutyoka and his colleagues were detained, we demand that they be brought before a court of law in accordance with due process.
