I recently read a federal court decision from the early 1900s (not sure of level, probably District Court) where the issue decided was whether a man in his 20s, who was born in this country to a Chinese national who, within a week of his birth, smuggled him and her aboard a vessel in the Seattle harbor bound for China or Singapore.

He lived in China until his early 20s when he decided to come to the US to further his education. Upon arrival in Seattle, he was denied entry by Customs or immigration enforcement. He argued in court that, even though he never set foot in the country during the intervening 20 or so years, he was, nevertheless, a US citizen. The court agreed with him.

I didn't read the latest Supreme Court case on birthright citizenship, but I understand one or more of the justices hinted that other remedies (besides a Constitutional amendment) existed to resolve the issue.

Perhaps the issue might be resolved by arguing that, although birthright citizenship is conferred by the 14th Amendment, a person could lose that citizenship following due process that determines that the citizenship was lost by his actions for an extended period (e.g., becoming a citizen of another country).
