🚨 FACT CHECK: The NYPD Is NOT Exempt From Psychology Licensing Laws 🚨
Some people keep claiming Education Law § 7605 gives the NYPD a blanket exemption to let unlicensed “psychologists” evaluate and disqualify candidates.
Let’s be clear — that’s fiction. Here’s what the law actually says:
🔹 § 7605 – Narrow Exemptions
1️⃣ Certain government employees can perform some psychological services only within the scope of their official duties, if otherwise qualified, and cannot use the title “licensed psychologist.”
2️⃣ Graduate students or interns may practice only under direct, on-site supervision and must be identified as “intern” or “psychological assistant.”
3️⃣ Testing technicians can administer certain instruments only under a licensed psychologist’s supervision.
📌 What’s NOT allowed:
– No blanket carveout for the NYPD to run psychological evaluations without licensure.
– No authority to perform full-scope evaluations, render diagnoses, or make fitness-for-duty determinations absent a license/permit.
🔹 § 7604 – Limited Permits
– Max 3 years + 1-year extension = 4 years total.
– Many NYPD assessors have been in these roles 5–10 years without a license. That’s a clear violation.
🔹 § 6512 – Practicing Without a License
– Performing psychological work without a valid license/permit = Class E felony.
🔹 § 6513 – Title Misuse
– Using “psychologist” without a license is a separate offense — yes, even if it’s in rosters, court filings, or ID cards.
💡 Bottom line:
No NY court has ever upheld this phantom “NYPD exemption.” Other departments in NYS follow the law and hire only licensed or board-permitted psychologists. The NYPD isn’t above the law — and this decades-long violation of Education Law is a scandal waiting for prosecution.

Another weak bill from @CMCarlinaRivera that doesn't require @CorrectionNYC to report on deaths of people medically or compassiona released from jail or on the releases themselves. If @NYSDOCCS can track this data why can't DOC?
