You say the current court precedent and legal precedent is that „born on american soil = not citizen automatically“
But at the same time you say the legal view needs to be updated so people who are born to illegal immigrants do not automatically become US citizens (since there are now phenomenas like birth tourism and so on)
Both can‘t be at true at the same time. Either the current court and legal precedent is that they are citizens and that needs to be updated/changed in your view.
Or the current precedent and legal view is that they‘re not. In which case it wouldn‘t need to be updated to conform to your preferences.

Most legal scholars reject the comparison between native americans and illegal immigrants, because Elk v. Wilkins was about the unique sovereign status of Native American tribes and not about immigration status in general.
In Elk, the Supreme Court said tribal members owed allegiance to their tribes, which the Court treated as separate “political communities” or “dependent nations.”
But in United States v. Wong Kim Ark, the Court distinguished Elk and held that children born in the U.S. to foreign parents are citizens because their parents are still under U.S. authority while living here.
It basically comes down to how the tribes were defined as a distinct sovereign entity INSIDE the US.

All i explained was that previously, as per Elk v. Wilkin(1884), native americans and their land were treated as sovereign entities. Therefor not, or not fully falling under US jurisdiction. And that is the reason why this act is needed.
