Dear @Hon_Njeri_Maina,
Appealing is a right, not a strategy for reversing political reality. The High Court has already spoken on the substance, and dragging the matter to the Court of Appeal won’t change the underlying findings. At some point, acceptance replaces constant litigation.
The Simple summary;
High Court: Jofri is IMPEACHED.
Meaning: Not Eligible to vie for any seat.
What Next: Court Of Appeal
Likely Result: Jofri is IMPEACHED
Next: Supreme Court
Likely Result: Jofri is IMPEACHED
SO? Sina Mengi kwa sasa....
Article 25(c) guarantees fair trial rights, but impeachment is not a criminal trial; it is a constitutional process with its own safeguards in Parliament and Senate. Courts only check if due process was followed, not re-try the case. Without clear procedural breach, judicial restraint applies.
@MigaiAkech A fair hearing finding only fixes the procedure, not the politics. Unless the court explicitly reinstates him, the Senate outcome still stands. Gachagua doesn’t magically bounce back into office or relevance from that.
Even if the court found problems with how the process was done, that does not mean the outcome is automatically reversed or that it changes the political reality. A fair process is one issue, but what led to the decision is another. In simple terms, fixing procedure does not equal restoring political standing or undoing consequences.
@scherargei One man's bitterness can never outweigh the interests of an entire nation. Thank you President Ruto for ensuring Gachagua's tribal politics met its inevitable end.
The High Court of Kenya 🇰🇪 has confirmed that as a senate of the Republic of Kenya we discharged our duty of impeaching Gachagwa judiciously, constitution , military precision and we saved this country from instability and division of the impeached deputy president Gachagwa.
I want to congratulate the High Court of kenya for the concise, precise and brilliantly comprehensive by UPHOLDING the impeachment of Gachagua this brings to a close to a promoter of negative ethnicity, balkanization of the country and division.
He will never run again for any elective position in kenya for eternity including the chair of Nyumbani kumi.
This is a win for all Kenyans and God almighty for one united indivisible nation under one flag and One God.
Blessed evening.
@WilliamsRuto Thank you President Ruto for finishing that Tribal bigot. Even in your absence, we can feel that tribal politics have no space in our country.
The High Court has upheld the impeachment of Rigathi Gachagua.
Riggy G has now been impeached again.
Fire si fire is the duly Deputy President of Kenya. Congratulations, Kithure Kindiki.
@MillicentOmanga Whether you accept it or not, Gachagua's political path is becoming narrower. President Ruto has successfully pushed back against ethnic-based politics.
@scherargei The challenge facing Gachagua is not merely political opposition but the inherent limits of identity-based politics in a diverse republic. President Ruto has capitalised on that weakness. Kenya's future belongs to leaders who speak to the nation, not just a constituency.
By now you know Gachagua stands impeached!
Those talking of going to court of appeal should know a ruling by 3 bench judges of High court, it’s very unlikely that the court of record will overturn it.
Gachagua stands impeached as at Article 75(3) of the Constitution.
His rights to FAIR TRIAL was violated & he is awarded Kshs 50M payable by the Senate
Justice Eric Ogola: We find that Gachagua’s rights were infringed when the Senate declined to allow an adjournment. This violation constitutes both a vindication of his rights and a recognition of the constitutional infirmity, but does not undo the impeachment itself
