This is the gap between the night and the report, from Title IX texts reported by The New York Times and CBS News. No one has been criminally charged.

𝟮𝟬 𝗢𝗰𝘁, 𝗺𝗼𝗿𝗻𝗶𝗻𝗴. A roommate said Jane Doe called the night crazy, laughed, seemed in shock, and did not call it rape. A second roommate said she did say she was not comfortable.

𝟮𝟮 𝗢𝗰𝘁. She went to Cornell Health with a UTI and said she had caught it in a “𝘵𝘳𝘢𝘶𝘮𝘢𝘵𝘪𝘤 𝘸𝘢𝘺.” She was told to speak to someone. She was not sent for a rape kit.

𝟮𝟮–𝟮𝟯 𝗢𝗰𝘁. One of the men apologised for how it went, said his memory was fuzzy, and said they should have shut it down. She replied that her memory was clouded too, that everyone was heavily intoxicated, and that “𝘯𝘰𝘯𝘦 𝘰𝘧 𝘵𝘩𝘦 𝘴𝘦𝘹𝘶𝘢𝘭 𝘴𝘵𝘶𝘧𝘧 𝘸𝘢𝘴 𝘪𝘭𝘭𝘦𝘨𝘢𝘭.” She said she liked being with him and another man, and suggested meeting again without “𝘵𝘩𝘦 𝘦𝘹𝘵𝘳𝘢 5 𝘣𝘪𝘭𝘭𝘪𝘰𝘯 𝘮𝘦𝘯 𝘢𝘯𝘥 𝘬𝘦𝘵𝘢𝘮𝘪𝘯𝘦.” The same day she texted “𝘦𝘷𝘦𝘳𝘺𝘰𝘯𝘦 𝘬𝘯𝘰𝘸𝘴,” and that it was “𝘙𝘜𝘐𝘕𝘐𝘕𝘎 𝘮𝘺 𝘭𝘪𝘧𝘦 𝘵𝘦𝘮𝘱𝘰𝘳𝘢𝘳𝘪𝘭𝘺,” and that all she could do was sleep and cry. He said she had nothing to be ashamed of.

𝟮𝟱 𝗢𝗰𝘁. He texted “𝘜 𝘨𝘰𝘰𝘥?” She said another of the men had definitely told people.

About a week on. She found a Greek-life forum post: Chi Phi do drugs and “𝘨𝘢𝘯𝘨 𝘳*𝘱𝘦𝘥 𝘢 𝘴𝘰𝘱𝘩𝘰𝘮𝘰𝘳𝘦.” She sent it to him. He called it ridiculous. She told investigators this was the first time the story was told as an assault rather than as her being a “𝘸𝘩𝘰𝘳𝘦.” A roommate said she had been explaining to Jane Doe that parts of the night could be classified as rape. Jane Doe had been assaulted before, that roommate said.

𝟮𝟴 𝗢𝗰𝘁. On a call a roommate overheard, she asked one of the men how he could let it happen.

𝗛𝗮𝗹𝗹𝗼𝘄𝗲𝗲𝗻. She still wanted to go to the Chi Phi party. He texted, “𝘤𝘩𝘪 𝘱𝘩𝘪 𝘪𝘴 𝘺𝘰𝘶𝘳 𝘩𝘰𝘶𝘴𝘦 𝘢𝘯𝘥 𝘺𝘰𝘶 𝘢𝘳𝘦 𝘸𝘦𝘭𝘤𝘰𝘮𝘦 𝘩𝘦𝘳𝘦,” passing on the president. She replied she would bring cigarettes. The president, who is not one of the seven, then called and disinvited her. He said it was for her own good. She texted: “𝘐 𝘬𝘯𝘦𝘸 𝘵𝘩𝘪𝘴 𝘸𝘢𝘴 𝘨𝘰𝘪𝘯𝘨 𝘵𝘰 𝘩𝘢𝘱𝘱𝘦𝘯. 𝘛𝘩𝘦 𝘸𝘰𝘮𝘢𝘯 ����𝘪𝘭𝘭 𝘢𝘭𝘸𝘢𝘺𝘴 𝘨𝘦𝘵 𝘵𝘩𝘦 𝘴𝘩𝘰𝘳𝘵 𝘦𝘯𝘥 𝘰𝘧 𝘵𝘩𝘦 𝘴𝘵𝘪𝘤𝘬. 𝘠𝘢𝘭𝘭 𝘢𝘳𝘦𝘯’𝘵 𝘮𝘺 𝘧𝘳𝘪𝘦𝘯𝘥𝘴. 𝘠𝘢𝘭𝘭 𝘢𝘳𝘦 𝘤𝘰𝘷𝘦𝘳𝘪𝘯𝘨 𝘺𝘰𝘶𝘳 𝘢𝘴𝘴𝘦𝘴.”

𝟯 𝗡𝗼𝘃. She texted two of the men that 90% of the night was not consensual, that she had been given more ketamine than she could remember, that she had said she was uncomfortable, and that she did not know anyone in the room. Another text said she felt like a “𝘴𝘦𝘹 𝘥𝘰𝘭𝘭/𝘸𝘰𝘳𝘬𝘦𝘳.”

𝟳 𝗡𝗼𝘃. She asked an Ithaca hospital for a rape kit. Two weeks had passed. The DNA was gone.

𝟴 𝗡𝗼𝘃. She reported it to Cornell University Police. The chapter and the seven were suspended the same day.

No one has been criminally charged. This is the night, from the complaint and from what she later told police.

Jane Doe was 20, a Cornell sophomore in Delta Delta Delta. She drank vodka at the sorority house, took an Uber with the house mother to a Tri Delta event at Moonies in Ithaca, then went to a second bar. She was under 21. At about 11 p.m. she walked alone to the Chi Phi house to meet a friend. The complaint says she arrived visibly drunk, after about ten drinks, and was given a beer.

A threesome was proposed with two men she knew. In the signed statement, as the DA quotes it, she agreed because she was attracted to one of them and out of “𝘥𝘳𝘶𝘯𝘬𝘦𝘯 𝘤𝘶𝘳𝘪𝘰𝘶𝘴𝘯𝘦𝘴𝘴.” In the 14 Nov interview she called that first encounter something she was “𝘱𝘳𝘦𝘵𝘵𝘺 𝘖𝘒 𝘸𝘪𝘵𝘩” while very drunk.

The complaint says she was then pressured into ketamine she had not used before, plus more alcohol and marijuana. The DA’s account of the signed statement says she snorted a line poured on one man’s penis, and agreed when asked if they could do drugs off her body. The same statement has her taking more ketamine later, thinking that if she passed out and sex continued it could be charged as rape. She also said one man kept reaching for her and she swatted his hand away, and that when she asked the conduct to stop, it stopped.

At 1:42 at 20 Oct a Chi Phi Snapchat, attached to the complaint, said sex was available upstairs. Then “𝘚𝘩𝘰𝘱 𝘴𝘵𝘪𝘭𝘭 𝘰𝘱𝘦𝘯?” and “𝘠𝘦𝘢.” She told police she was cornered, naked, under the covers, as more men got into the bed, and that she was hit, hard. She said she lost the end of the night and did not know how many men had sex with her. The complaint says she was incapacitated by about 5:45 a.m.

ABC News has also reported a redacted Cornell file noting a ketamine overdose at the same house on or about 18 Oct, the day before. That is a separate incident.
