Pervis Payne has an IQ of 72 and there is additional evidence that he is intellectually disabled. The Tennessee Supreme Court has previously said that the state has no interest in executing intellectually disabled people, but denied Pervis an opportunity to prove his disability.
Byron Black has brain damage, schizophrenia, and an IQ of 67. He is not legally competent for execution. Byron can barely walk, needs two hip replacements, and gets pushed around the prison in a rolling office chair. He is not a danger to society.
What in the world is going on in Tennessee? The state’s high court just set execution dates for Byron Black and Pervis Payne. Neither of these men are mentally competent. The Constitution forbids executing people in their circumstances. @GovBillLee needs to hit the brakes now.
TN plans to execute Lee Hall tonight. Lee is blind — a result of the state’s refusal to treat the glaucoma he developed in prison. A state worker will have to guide Lee into the electric chair due to his disability. Another example of our system’s devolving standards of decency.
.@GovAbbott appointed every member of the Board of Pardons and Paroles. The Board voted unanimously to recommend a 120-day reprieve for #RodneyReed. Governor: You entrusted these Board members with this power when you appointed them. Please listen to them now. Grant the reprieve!
MAJOR #RodneyReed NEWS: The Texas Board of Pardons and Paroles just unanimously voted to recommend a 120-day reprieve. @GovAbbott should follow their recommendation and grant the reprieve immediately.
I'm very disturbed by Georgia's plan to execute Ray Cromartie. Ray has always maintained his innocence. A co-defendant says that someone else confessed to the crime. The murder weapon was never tested for DNA. The victim's daughter supports halting the execution. More tomorrow.
Rodrick Reed, Rodney’s brother, says this is a “nightmare that you can't wake up from.” He says his brother is “standing on the truth and has faith.” But at the same time, he says: “He's scared. Scared as hell. Because this execution date is real.”

South Dakota is planning to execute Charles Rhines tomorrow. Charles, a gay man, was sentenced to death by homophobic jurors. They sent him to death row because he is gay. This is unconstitutional and just plain wrong. I’m calling on @govkristinoem to put a stop to this now.
Good news! Bobby Moore has finally been removed from death row in Texas. Bobby is intellectually disabled and his lawyers had to take his case to the U.S. Supreme Court multiple times before Texas officials agreed to comply with the law. Bobby is now serving a life sentence.

“It is deeply unfair that an innocent man would be forced to choose between entering a plea to secure his immediate freedom and waiting years more in prison to prove his innocence through litigation.” —@InnocenceProjNO attorney Charrel Arnold

Georgia just announced plans to execute Ray Cromartie on October 30th. None of the physical evidence in Ray’s case was tested for DNA before his trial and the state is now refusing to test the evidence before his execution. Why aren’t Georgia officials interested in the truth?
I am concerned about James Dailey’s case in FL. There is no physical evidence, only testimony from a co-defendant who received a reduced sentence and who has changed his story numerous times over the years. @GovRonDeSantis should review this case and stop the Nov. 7 execution.
