Dear City Clerk Lydia McComas:
1. Pursuant to Wisconsin’s Public Records Law, Wis. Stat. §§ 19.31–19.39, I request electronic copies of the following records concerning the City of Madison’s use of Flock Safety equipment, software, services, and data.
2. For purposes of this request, “Flock” includes Flock Group Inc., Flock Safety, affiliated entities, and any reseller, contractor, or agent acting on its behalf. “City” includes the City of Madison, the Madison Police Department, and any City department, officer, employee, contractor, or agent possessing responsive records.
**Contracts and Agreements**
3. For the period January 1, 2022, through the date the City receives this request, please provide:
4. Every current or former contract, agreement, memorandum of understanding, order form, accepted quote, statement of work, subscription, license, data-sharing agreement, or other agreement between the City and Flock.
5. Every amendment, addendum, appendix, exhibit, attachment, renewal, extension, modification, side agreement, and document incorporated into any such agreement, including applicable terms of service, privacy policies, and data-retention terms.
6. Any agreement authorizing another governmental or private entity to access, search, receive, share, retain, or otherwise use data collected through the City’s Flock equipment or account.
7. Any agreement or record showing that another governmental entity, private organization, business, homeowners’ association, or third party purchased, funded, donated, sponsored, installed, or provided Flock equipment or services used by or accessible to the City.
**Flock Records for the Most Recent 30 Days**
8. For the 30 consecutive calendar days immediately preceding the City’s receipt of this request, please provide the following existing records for every Flock camera, automated license-plate reader, sensor, device, account, database, or system used by or accessible to the City:
9. All license-plate reads, vehicle-detection records, vehicle descriptions or classifications, photographs, images, video, audio, timestamps, locations, directions of travel, confidence scores, and associated metadata.
10. All alerts, notifications, hot-list hits, wanted-vehicle alerts, stolen-vehicle alerts, missing-person alerts, custom-list alerts, and other system-generated alerts.
11. Records identifying each Flock device, including its device or camera identification number, serial number, assigned location, GPS coordinates, installation location, and operational status.
12. All search, query, access, login, activity, audit, download, export, sharing, modification, deletion, and administrative logs, including the user or account involved, date and time, search criteria, stated purpose, and results returned.
13. Records showing access to, disclosure of, or sharing of Flock data with any other governmental authority or private entity.
14. Records identifying every agency, entity, user, or account authorized to access or search data generated by the City’s Flock equipment or account.
15. Records of searches conducted through the City’s account involving external, regional, statewide, nationwide, or shared Flock networks or data generated outside the City.
16. Records showing the retention, preservation, archiving, downloading, exporting, deletion, or extended retention of Flock data.
17. An inventory of every Flock device associated with the City, including devices that were active, inactive, disabled, removed, replaced, or under maintenance.
18. All records or logs showing the collection, detection, receipt, transmission, storage, access, or use of GPS data.
19. All records or logs showing the collection, detection, receipt, transmission, storage, access, or use of Bluetooth signals, identifiers, device information, or other Bluetooth-derived data.
20. For records maintained electronically, please provide them in their existing native or ordinarily exportable format, including CSV, XLSX, JSON, PDF, JPG, PNG, or MP4. This request seeks existing records and does not ask the City to create a new record or perform an analysis.
**Electronic Delivery**
21. Please provide the records by email. If the files are too large for email, a Dropbox, Google Drive, OneDrive, SharePoint, secure file-transfer, or comparable download link is acceptable. Please preserve original filenames and metadata where reasonably possible.
22. Responsive records may be produced on a rolling basis.
23. If any part of this request is considered unclear, please identify the particular language requiring clarification and continue processing the portions that are clear.
24. Please confirm receipt and provide the responsive records as soon as practicable and without delay.
