Retired firefighter stopped to save a man's life, ended up in cuffs for his efforts. Lawsuit followed. with a dislocated shoulder.

​ Santa Paula, California, retired Oxnard firefighter Joseph Garces, 27-year veteran of the fire service was driving his Jeep when he spotted a man lying on the ground in commercial parking lot.

​Garces immediately pulled over to render aid. Garces jumped into action: ( not seen in the video)
• Administered emergency CPR
• Safely removed a firearm from the victim's waistband and secured it inside his own vehicle to neutralize any immediate threat
• Used a pocketknife to cut away the victim’s clothing to treat the injuries

The video starts when first responders from the Santa Paula Police Department arrived, Garces stood by calmly to brief them on the situation, pointing out where he had secured the weapon and detailing what he saw.

​However, the encounter quickly escalated when Santa Paula Detective Chris Rivera arrived on scene.

​Instead of coordinating with the other officers already interviewing Garces, Detective Rivera aggressively ordered Garces out of the crime scene perimeter. Garces complied and began moving away, but verbally expressed his frustration at how he was being treated after saving a man’s life.

​As Garces reached the perimeter, Detective Rivera followed him and placed a hand on his shoulder. When Garces pulled his arm away and told the detective not to touch him, Detective Rivera immediately seized Garces' right arm behind his back.

​Garces was placed in handcuffs and locked in the back of a patrol car for roughly 15 minutes before being uncuffed and released without any charges.

​Shortly after his release and the body cam ended, Garces had to be transported to Community Memorial Hospital via ambulance.

The force used during the detention resulted in an injury: a dislocated shoulder and a torn labrum requiring surgical repair.

​The victim Garces helped, Samir Salgado, ultimately survived the attack, and police later arrested and charged the suspect with attempted murder.

​Garces filed a federal civil rights lawsuit against Detective Rivera and the City of Santa Paula, alleging excessive force and constitutional violations. While a federal judge initially granted qualified immunity on the federal excessive force claim regarding the specific control hold, state law claims moved forward, leading the City of Santa Paula to reach a confidential settlement with Garces.

​A classic example of how ego, poor communication, and unnecessary escalation can turn a life-saving rescue into a costly civil rights incident.

Another case where the citizens pay the bill for an out of hand officer.
