NEW RULES FOR SPAM CALLS
South Africa’s updated Consumer Protection Act (CPA) regulations came into effect on 15 April 2026, introducing stricter controls on telemarketers.
Central to the changes is a national opt-out registry, managed by the National Consumer Commission, which allows consumers to block unsolicited marketing communications.
Under the new rules, direct marketers are required to register with the Commission and renew their registration annually. They must also cleanse their databases every month against the registry and are prohibited from contacting any individual who has opted out.
Ahmore Burger-Smidt from Werksmans Attorneys (pictured), explains that the regulations further outlaw anonymous marketing, requiring businesses to clearly identify themselves in all electronic communications.
For consumers, the process is straightforward: a single form submission enables them to block unwanted calls and messages, marking a significant shift in control away from marketers and towards the public.
