Reuters confirmed it — Federal Judge rules Biden-era gun rule is unconstitutional. U.S. District Judge Reed O'Connor in Fort Worth ruled Monday that the 2022 Biden rule violates the Second Amendment right to keep and bear arms and is too vague for Fifth Amendment due process. The rule required manufacturers of ghost gun kits and parts — partially complete frames/receivers — to mark with serial numbers, obtain licenses, and conduct background checks as for commercial firearms. Said kits are covered by the "firearm" definition under the 1968 Gun Control Act. Supreme Court in March 2025 overturned O'Connor's earlier ruling, but the 7-2 ruling focused not on the Constitution but on whether ATF exceeded its authority. So Second Amendment Foundation and Defense Distributed asked O'Connor to block again on constitutional grounds. O'Connor: rule infringes right to make or repair personal firearms by restricting access to necessary components and "contradicts actual historical tradition of personal gunsmithing." Quote: "Self-manufacture of firearms in America was common and indeed foundational to establishing our Nation." Judge blocked enforcement against Defense Distributed and Second Amendment Foundation members. Group's Adam Kraut hailed ruling, calling Biden-era rule "a mess." Gun control group Everytown says "egregiously wrong," expects appeal.
