Delhi Police ACP Vivek Bhagat says, "Yesterday, I was on duty in sector one zone one which includes the main Jantar Mantar area. I was on duty during the day and I had evening shift as well, so during the evening shift, I was going to report from Regal building which is Connaught Place, via Sansad Marg, at the red light of Tolstoy and Sansad Marg. I had a staff of five or six who were walking ahead and with me was an ACP probationer Rohit and my operator Navneet. So as we were walking ahead, we realized that water bottles were being thrown at the staff in front and hooting and anti-social slogans were being raised against the police. So as soon as our police staff moved back and forth a little there, some of them moved forward to save their lives and one of them was overpowered by the crowd. Blood was coming out of his head. His entire face was covered in blood, so I tried to intervene to rescue him from there. We even brought him a meter or two forward, but the crowd was so huge and violent. They even overpowered me. The crowd was so violent. Police officers were specifically targeted, isolating them and attacking them..."

▪️In Ankush Sehgal v. State of Uttarakhand & Anr., Uttarakhand HC quashed a rape on the false promise of marriage case, holding that a consensual relationship between two adults who met through the Tinder dating app could not subsequently be treated as rape merely because the relationship failed to culminate in marriage.

▪️Court observed that material on record did not disclose an offence u/s 376 IPC but reflected a voluntary relationship between two consenting adults.

▪️According to prosecution, complainant came in contact with the applicant through Tinder app in August 2019. They became friends, met in Haldwani, visited Bhimtal and Hanuman Dham, and later went to applicant’s hotel where they consumed liquor. The complainant alleged that they entered into a physical relationship under the influence of alcohol, following which applicant repeatedly assured her that he would marry her and continued to have sexual relations with her.

▪️She further alleged that after COVID-19 lockdown, applicant started avoiding her on the pretext of his father’s ill health and refused to marry her. She eventually learnt through Instagram that he had got engaged to another woman and thereafter lodged an FIR u/s 376 IPC alleging that the physical relationship had been established on a false promise of marriage.

▪️Before High Court, applicant argued that Tinder is a dating platform and not a matrimonial website, and therefore the relationship was consensual from its very inception. He contended that both parties voluntarily entered into the relationship, there was no promise of marriage at the beginning, and FIR was lodged only after the complainant learnt of his engagement.

▪️High Court examined the FIR as well as the statements recorded u/s 161 and 164 Cr.P.C. and found it undisputed that parties had met through Tinder, voluntarily met each other in Haldwani, consumed liquor and entered into a physical relationship. Court noted that even State did not dispute that physical relationship was consensual.

▪️Relying on precedents, High Court reiterated that consensual physical intimacy during a genuine relationship cannot retrospectively be converted into the offence of rape merely because the relationship eventually breaks down.

▪️Therefore, Court held that the allegations did not disclose a case of rape on the false promise of marriage and allowing the prosecution to continue would amount to an abuse of the process of law.

▪️In this case, Bombay HC refused to grant interim maintenance of ₹1 lakh per month to a wife residing in US, holding that a spouse who is financially independent and earning substantially more than husband cannot seek maintenance merely because the cost of living abroad is high.

▪️The wife filed an appeal challenging Family Court's judgment granting divorce to husband on grounds of adultery and desertion. Family Court had also refused to grant permanent alimony, awarded custody of elder son to husband, and directed husband to pay only ₹25,000 towards litigation expenses. During pendency of appeal, wife filed an application u/s 24 HMA seeking ₹1 lakh per month as interim maintenance.

▪️Wife contended that although she was employed in US, her income was insufficient to maintain the standard of living enjoyed during the marriage. She submitted that she was residing in a rented apartment, bearing expenses of raising the younger son, and facing uncertainty regarding the continuation of her employment. She further argued that husband possessed several properties and was financially well-off.

▪️The husband opposed the application by pointing out that wife had been residing in US since 2011, is employed, and is earning a gross monthly salary of USD 8,700. He submitted that Family Court had already examined her financial status and found that she earned substantially more than him. He further stated that he was bearing the educational expenses of their elder son studying in Australia, supporting his elderly parents, and had remarried after divorce, thereby taking on additional family responsibilities.

▪️High Court noted that wife possessed professional qualifications and had been living abroad for nearly 15 years. It observed that salary documents produced by wife herself established that she continued to earn a substantial income of USD 8,700 gross per month. Court held that she had sufficient independent means to support herself and therefore could not be regarded as financially dependent on the husband.

▪️Therefore, High Court found that the wife was a highly qualified professional earning substantially more than the husband.

▪️A 30-year-old woman, Sunita Hariram Singh, struck her husband, 35-year-old Hariram Kishunji Singh, with a pressure cooker lid and then strangled him to death at their rented home in Badlapur East, Maharashtra, following an argument over sarees.

▪️The couple, originally from Bihar's Rohtas district, had been living in Badlapur for nine years with their seven-year-old son.

▪️The argument over Hariram not buying sarees for Sunita escalated so much that it turned into a violent assault resulting in the death of Hariram.

▪️Their seven-year-old son reportedly ran to the landlord's house seeking help, but before anyone could intervene, the assault had already taken place. The accused attempted to pass off the death as a heart attack after the quarrel.

▪️Police initially registered an Accidental Death Report based on the woman's statement.

▪️However, the post-mortem examination revealed injuries inconsistent with a natural death, prompting the registration of a murder case. During questioning, the accused confessed to the crime.

▪️In SK v. State of Madhya Pradesh & Ors., MP High Court quashed a rape case based on the alleged false promise of marriage filed against a Central Government employee by his colleague, who was a married woman and mother of a 9-year-old daughter.

▪️The complainant alleged that accused had established physical relations with her from 20 October 2020 to 30 March 2024 on the false promise of marriage. She further alleged that he had initially raped her after making her unconscious by offering her an orange drink. Consequently, an FIR was registered u/s 376(2)(n), 342, 294, and 506 IPC.

▪️The accused contended that allegations were false and motivated. He argued that complainant was already married and had never obtained a divorce from her husband, making any promise of marriage legally impossible. He further pointed out that FIR was lodged after an unexplained delay of nearly 4 years.

▪️The petitioner also relied on WhatsApp chats to show that prosecutrix herself had proposed a relationship with him. He further produced bank statements and UPI transaction details to demonstrate that she had repeatedly borrowed money from him. According to petitioner, case was filed only after he refused to make further payments.

▪️Court observed that both parties were adults who had remained in a consensual relationship for nearly 4 years. It noted that complainant was admittedly a married woman and mother of a 9-year-old daughter when the relationship began.

▪️Court further stated that complainant had voluntarily continued the relationship for 4 years, admitted that petitioner had never threatened or blackmailed her, and borrowed money from him through bank transfers and UPI transactions.

▪️Therefore, High Court held that, even if the complainant's allegations were accepted at face value, it was improbable that a married woman would enter into a physical relationship solely on the basis of an assurance of marriage.

▪️Accordingly, Court concluded that physical relationship between the parties was consensual and could not be characterised as being without the complainant’s consent or against her will.
