βοΈCOURT UPDATEβοΈThe federal court has now entered a full case schedule in Carter v. Buzbee, putting the lawsuit on a formal discovery track through early 2027. A Civil Case Management Plan and Scheduling Order signed by Judge Dale E. Ho on May 18, 2026.
Under the order, initial disclosures are due by June 3, 2026, any motions to amend pleadings or add parties must be filed by May 22, 2026, and fact discovery must be completed by December 31, 2026. The order also requires initial document requests by July 3, 2026, interrogatories by October 30, 2026, and expert discovery to be completed by February 26, 2027.
The parties also indicated that the case will be tried to a jury, that they do not consent to all further proceedings before a magistrate judge, and that settlement discussions have not yet taken place. The form further reflects that the parties believe a protective order is warranted, while noting they have not reached a Rule 502 agreement.
