This June, NIL collectives paid athletes… 824% more than they did last June - perhaps the most revealing front-loading figure yet.
Also: Athletes projected to get $2.75B this year in Rev-Share + NIL.
Today is a historic day for college sports. Judge Wilken will review the House antitrust settlement. If she approves it, colleges can directly pay players, who will still get full scholarships & NIL deals.

@WinterSportsLaw@achristovichh Agree with @WinterSportsLaw - the settlement doesn’t protect the NCAA or allow it to enforce compensation rules w/o risk of more litigation. It’s a bandaid that may temporarily stop the bleeding, but it doesn’t cure the underlying problem behind the bleeding.

An NCAA subcommittee is considering changes to allow schools to be more involved in obtaining deals and providing related services (tax, legal).
Based on a draft doc, it appears athletes would also be allowed to engage in NIL activity while “on call.”
This is a great example of a co-branded NIL deal, which means it uses school marks and IP and an athlete’s NIL.
There was also likely some work with LSU’s MMR rights holder that went into getting the deliverable placed on the football team’s social account.
That's a great irony of the NCAA opposing college athletes as employees. If they're employees & can form a union (or multiple unions), colleges/conferences/NCAA could negotiate employment rules with them that, through the labor exemption, would be immune from antitrust scrutiny.
In these few paragraphs, Matt gets to THE biggest current issue with college sports.
The NCAA and others want to treat college athletes as employees.
But they want to deny them the ability to be employees and to have the rights that go along with that.
Can’t have it both ways.
Not that those are are paying attention didn’t already know, but the memo for tomorrow’s congressional hearing makes clear that the effort to pass a federal #NIL law is an effort to restrict athletes’ ability to monetize their NILs.
More importantly, you’ve challenged them to think big about their careers, to see challenges as opportunities, to pursue their passions, to take risks, and to not let the fear of failure stand in the way of doing great work, being a game-changer, and making a difference!

NCAA's most recent #NIL guidance includes warning to schools that its enforcement staff and Committe on Infractions "will presume a violation occurred unless the school clearly demonstrates behaviors in question were in line with existing NCAA rules and the interim policy."
