Law school exam question:
Non-profit organization, Acme Nonprofit, has been in existence for three years. The first two years Acme had virtually no income or expenses and was eligible to file a Form 990-N which is a postcard filing that includes virtually no financial information. The third year, the organization exceeded the threshold for the Form 990-N and was required to file a Form 990-EZ by March 16.
On March 15, Internet Troll, accuses an executive of Acme, Jackie Leed, of financial mismanagement because "they've been in existence for three years and have been flying witnesses around the country and that takes a lot of money and I know a lot about NGOs so something's up because they did not file Form 990s and this executive needs to resign."
State the possible tort claims that Acme and Leed have against Troll and analyze their chances of success.
