Sharing a joke - however distasteful or offensive - should never be an offence. Bearing in mind:

"discussion, criticism or expressions of antipathy, dislike, ridicule, insult or abuse of particular religions or the beliefs or practices of their adherents, or of any other belief system or the beliefs or practices of its adherents"

is expressly protected under s.29J POA '86.

Surely an offensive joke comes within "abuse" or "insult" and thus not an offence.

The problem? s.29J does not act as a defence to a s127 charge, which calls for any "message or other matter" that is "grossly offensive" to be prosecuted.

This had led to courts convicting on the latter whilst ignoring the obvious free speech implications expressly codified in the POA - which, I aver - are absolutely relevant to a s.127 offence and should be taken into account.

And that's before we consider that we abolished blasphemy offences 18 years ago for this very reason.

In short, in my respectful view, this is an abuse of our laws to shoehorn jokes pegs into an offence holes, and is entirely unacceptable.
