The mother of Brendan Depa, the teen who b—at his teacher unconscious after she took away his Nintendo, claims her son was sentenced to five years in prison because he is Black.

Depa was sentenced to five years in state prison and 15 years of probation for the att—k.

His adoptive mother, Leanne Depa, argues that her son is being unfairly punished because of his race and disability.

“They are punishing that he is Black, they are punishing that he is large and they are punishing his disability,” she said.

“I think he needs help. I think he needs treatment but I don't think he needs to be put away in a prison where he's going to be taken advantage of or h—rmed.”

The teacher suffered br—ken ribs, a concussion and has PTSD.
