When misused, it allows companies to shift profits from high-tax jurisdictions like Namibia to low-tax or no-tax jurisdictions, thereby reducing their tax liabilities. This can be achieved by:
•Underpricing mineral exports: Selling minerals to affiliated companies at below-market prices.
•Inflating expenses: Overstating costs such as management fees or interest on loans from parent companies.
•Declaring perpetual losses: Reporting continuous losses to avoid tax payments, despite ongoing operations.

These practices are particularly concerning in Namibia’s mining sector, where foreign multinationals dominate. A 2024 report by the African Peer Review Mechanism highlighted that Namibia’s inadequate tax laws and limited enforcement capacity make it vulnerable to such aggressive tax planning strategies.
