Hello, everyone. On the evening of August 6, I had the opportunity to be a guest resource person on the SMNI Media program Nightline News, hosted by MJ and Admar. The discussion delved into several pressing issues. But let me share my perspective first on the controversial inclusion of former Presidential Spokesperson Atty. Harry Roque on the Immigration Lookout Bulletin Order (ILBO) list due to alleged connections with Philippine Offshore Gaming Operators (POGOs). To me, Roque in the ILBO list in connection with issues related to POGO is ARBITRARY.

First and foremost, the foreigners, more specifically, a Chinese national named Mr. Sun, a wanted fugitive in China who is on the Interpol list, were apprehended in the alleged house of Atty. Roque is accused of financial fraud, and accusations against this individual have nothing to do with illegal gambling like POGO.

Second, based on his testimony during the last Senate hearing on this issue, it was clear that Roque’s involvement was limited to rescheduling the arrears payments of a lessee and principal of Roque’s client, Whirlwind Corporation, and in the same senate hearing and even in previous news items, even, Alejandro Tengco, PAGCOR Chief, clarified that Roque did not exert pressure but merely ASSISTED a certain Cassy Ong.

Third, Roque’s name allegedly appeared in the organizational chart of the concerned corporation, but according to Roque, this was without his consent, and he did not know about it.

On this note, Harry Roque's inclusion in the ILBO lacks solid evidence. Should the responsible government agency assert the existence of a legal basis, it relies on insufficient, uncorroborated, and unverified evidence, rendering the action seemingly ARBITRARY. This situation also prompts several critical questions:

The action against Roque was unjustified and lacked proper and sufficient legal evidence. Including Roque in the ILBO was no doubt arbitrary, devoid of due process, and unsupported by sufficient legal evidence. Consequently, any suspicion against Roque lacks credibility, and the ILBO against him cannot be deemed proper.

Moreover, the Philippine Constitution of 1987, Article III, Section 6, enshrines the right to travel, which can only be restricted under specific legal grounds. This underscores that any limitations, such as an ILBO, must be grounded in clear and lawful justification, reflecting the constitutional guarantee of individual freedoms and welfare.

Regarding the principle of presumption of innocence, it is fundamental that every individual, including Harry Roque, is considered innocent until proven guilty. Placing someone on an ILBO does not signify a conviction but is a preventive measure. Nonetheless, such measures mustn’t compromise an individual’s right to be presumed innocent or subject to undue harassment. Roque’s inclusion on the ILBO list appears to be an overreach and an infringement on his constitutional rights. Given the limited nature of his alleged involvement in the case, this action constitutes an unnecessary violation of his fundamental rights protected by the PH Constitution.

Conclusion
The ILBO is a measure designed to ensure individuals involved in significant legal cases remain available for investigation and trial. However, its application must be careful and fair to prevent infringing on fundamental individual rights.

In my view, the action against Atty. Harry Roque appears to be political harassment, considering his prominent role in the MAISUG movement and his alliance with the Duterte family.
