There’s no question that divorce is financially punishing for both partners — and that it has historically been most consequential for low-income mothers. But over the last few years, the financial consequences of ending a marriage have worsened for women in the upper-middle-class (and higher) tax bracket, particularly in New York. And amid the financial fallout, many of these women say that despite being ensconced in a culture of empowering, stigma-vanquishing divorce narratives, they had no idea they would lose so much money.

This strange duality — celebrating divorce even as it becomes more financially taxing for women — has taken shape because the same push for gender equity may have also, more quietly, shifted marital laws. In New York, the laws no longer operate under the assumption that women need financial protection after divorce, nor that their earning potential is less than a man’s. It sounds feminist — like an acknowledgment of women’s growing participation and power in the labor market. But divorce scholars say these shifts are based in ideology, not reality, and they have been enacted too soon.

The result is that many divorced women find themselves in worse economic straits than they would have faced just ten years ago.

Women continue to earn less than men with the same job titles, and they are more likely than men to quit or shift to part-time hours to raise their children. Yet the percentage of divorces that result in spousal-maintenance (formerly known as alimony) awards has dropped from about 25 percent to around 10 percent since the mid-20th century — and for those who do receive payments, the amounts and durations have fallen too.
