Timothy J. Bradl, the attorney for jailed #TurtleBoy blogger Aidan Kearney, is the subject of a motion for court sanctions by the Office of Special State Prosecutor Ken Mello. This, according to Mello, after Bradyl lied to jailhouse officials about a civilian named Jen Altman being a lawyer for the purposes of holding unrecorded phone calls with Kearney.
A court hearing on the motion for sanctions is scheduled in front of Judge Peter B Krupp in Norfolk Superior Court in Dedham, Massachusetts, on Friday, January 26th, after 9AM.
In a shocking series of allegations, Mello has told the court that there is confirmation that Attorney Bradl called the jail where Turtleboy is housed (in protective custody), told the jail that someone named "Jen Altman" was a lawyer who could be put on a special list to talk to Kearney without being monitored, only for jail officials to discover Altman was not a lawyer and that Bradl had abused his position as an Officer of the Court to facilitate those communications.
Altman's contacts with Kearney were cut off when the deception was discovered and this information was not disclosed by Altman, or anyone else, until this motion was docketed today by the Special Prosecutor.
As a result, and for the first time in the nation's history, the Special Prosecutor is requesting that a "real time taint team" be deployed by the Court.
This would come in the context of an order barring Kearney from speaking to anyone but his lawyers while Kearney is jailed on a bond violation following Kearney's arrest, in late December 2023, on charges of domestic violence and witness intimidation (Kearney is also subject to a 365 day restraining order in the context of that same incident, after a Judge found the victim in the case met her burden under the statute for that order to be extended).
Despite that order from the Court, Kearney and his contacts in the free world have engaged in a continued pattern of intimidation and shaming directed at the victim in that domestic violence case, even going so far as to upload unredacted court sidebar audio indicating the victim's children were the subject of active threats (via unwitting state agencies) while the victim was in court in front of the judge.
In turn, if Kearney wants to talk to his lawyers from jail, the Special prosecutor is asking that those Attorneys be forced to travel to the offices of the court-approved "taint team" so that the Court can be assured no unauthorized parties are taking part in the call.
While such "taint teams'' are common when a criminal defendant asserts a claim of legal privilege as to recorded or oral communications with their Attorneys, a real-time taint team of this nature is unheard of.
As such, should this order issue from the Judge it would reflect a rapid adaptation on the part of the Court system, in equity and in law, to the complex challenges faced by modern social media that, much like the Supreme Court ruled in Adderly V Florida, threaten the integrity of the judicial process to its very core (even if those threats occur in a non-temporal space, removed from direct proximity to the courthouse). Such a standard, even in the Cox v Louisiana case from the year prior, was also evident (even if Reverend Cox escaped conviction on the material charge by a mere 1 vote - if only because of those specific reservations that eventually became law in Adderly).
Mello is also asking for a monetary fine to be imposed on Bradl by the court.
It is unclear if a complaint has been filed with the state’s Board of Bar Overseers (BBO) as a result of Bradl’s alleged conduct.
