Here’s a short decision by an Ontario arbitrator on the firing of employees in the William Osler Health System for refusal to be vaccinated.
The arbitrator found the vaccination requirement was reasonable and that the terminations were for just cause. (With rare exceptions this issue is not fully thought through in either courtrooms or in arbitrations.) However the employees were entitled to compensation as their conduct may have been “misguided” but was not “willful misconduct, disobedience or willful neglect of duty”.
Severance pay ordered. Small steps.
