You’d need to understand the jury instructions and evidence to assess the limitations verdict.

It may have been a near clear-cut defense. If so, Musk and his lawyers surely knew that but weighed the odds of recovery against the costs of suit. A near $200 billion recovery against say $50 million investment in lawyer fees and costs, even at low win percentage is a not a crazy wager, especially if the journey (litigation and a public trial) has intrinsic value.

The appeal will take 18 months and will be a cloud over Open AI. This and what the public learned about Altman and the company mgmt and conflict-ridden 3d party deals really hurt the planned IPO. It feels like a bunch of round trip payments.
