ANKLAGESCHRIFT

In der verfassungsrechtlichen Sache der Bürgerinitiative „Gemeinwohl Jetzt“, vertreten durch die Unterzeichner,– Klägerin –gegen die Bundesrepublik Deutschland, vertreten durch die #Bundesregierung ,– Beklagte –wegen:
Fortlaufenden, passiven Verfassungsbruchs durch die systematische Verletzung der staatlichen Schutzpflichten (Art. 2 Abs. 2 GG) in Tateinheit mit der vorsätzlichen Nichtanwendung des Artikels 15 GG zum Schutze der Allgemeinheit vor destruktiven Monopolstrukturen.

Das Verfahren wird initiiert und im Hintergrund überwacht durch das Büro des Legatus in umbra.

BEGRÜNDUNG:
I. Der Sachverhalt
Die Beklagte führt seit Jahrzehnten eine #Politik des bewussten, koordinierten Wegsehens. Strategische Kernsektoren der Daseinsvorsorge – namentlich die #Energieversorgung , kritische #Infrastrukturen und die medizinische #Versorgung – wurden der unkontrollierten Profitmaximierung privater #Monopole überlassen. Diese Wirtschaftsakteure blockieren nachweislich den gesellschaftlichen und technologischen Fortschritt, um exzessive Renditen zu sichern, manipulieren Märkte und entziehen der Bevölkerung systematisch die existenziellen Lebensgrundlagen.

Staatliche Kontrollbehörden und Institutionen verschleppen systematisch Ermittlungen, halten Beweise zurück und behindern Aufklärer sowie #Whistleblower . Dies geschieht nicht aus Unvermögen, sondern mit dem inhärenten Ziel, das übergeordnete System dieser Monopole und die damit verflochtenen politischen Machtcliquen vor dem Zugriff des Souveräns zu schützen. Der Staat hat seine Rolle getauscht: Er schützt nicht mehr das Volk vor den Monopolen, sondern die Monopole vor dem Volk.

II. Rechtliche Würdigung
1. Verletzung der staatlichen Schutzpflicht (Art. 2 Abs. 2 GG)
Aus dem Grundrecht auf Leben und körperliche Unversehrtheit leitet die ständige Rechtsprechung des Bundesverfassungsgerichts eine aktive staatliche Schutzpflicht ab. Der Staat ist kein reiner Zuschauer, sondern der oberste Garant für das Wohl der Allgemeinheit. Diese Pflicht erstreckt sich explizit auf den Schutz vor existenziellen Bedrohungen durch wirtschaftliche Machtkonzentrationen, welche die Gesundheit oder die Lebensgrundlagen der Bevölkerung beschneiden.

Durch das bewusste Gewährenlassen der Monopole hat die Beklagte die Grenzen ihres verfassungsrechtlichen Gestaltungsspielraums evident überschritten; das regulatorische Ermessen ist angesichts der akuten Schädigung auf Null reduziert.

2. Bewusste Nichtanwendung des Art. 15 GG („Pflichtwerkzeug“)Artikel 15 GG wurde von den Verfassern als finales, schärfste Schwert des Grundgesetzes implementiert, um das Gemeinwohl zu sichern, wenn der freie Markt versagt oder Monopolbildungen gemeingefährlich werden. Indem die Beklagte dieses Werkzeug zur Vergesellschaftung von Produktionsmitteln und Monopolen im Keller verstauben lässt, opfert sie das verankerte Wohl der Allgemeinheit zugunsten privater Profitinteressen. Dieses dauerhafte, bewusste Unterlassen stellt unter den gegebenen Bedingungen einen fortlaufenden, passiven Rechtsbruch am eigenen Volk dar.

III. Beweisantritt/Sachbeweis:
Vorlage der im Verborgenen gesicherten Dossiers des Legatus in umbra über die personellen, finanziellen und strategischen Verflechtungen zwischen den Bundesministerien und den Vorständen der betroffenen Monopolkonzerne.

Zeugenbeweis:
Vernehmung der zuständigen Behördenleiter zur Chronik des institutionalisierten Wegsehens und der gezielten Behinderung von internen Aufklärern.

IV. Anträge
Die Klägerin beantragt festzustellen: Dass die Beklagte durch ihr passives Unterlassen gegen die staatliche Schutzpflicht aus Art. 2 Abs. 2 GG verstoßen hat.

Dass die Beklagte verfassungsmäßig verpflichtet ist, unverzüglich das Instrumentarium des Art. 15 GG zu aktivieren, um die schädigenden Monopolstrukturen zu zerschlagen und in Gemeineigentum zu überführen.
