If you or anyone you know is using Constant Contact, a little birdie told us (and gave us permission to repeat) that they are requiring DMARC for ALL of their customers, not just those who send 5000 or more pieces to Google or Yahoo (the now celebrityname mashed-up"Yahoogle"). They also make it as easy as possible to implement it with these step-by-step instructions.

Here is our Plain English Explanation of the New Requirements for Sending Email to Google and Yahoo Taking Effect in 2024
The new 2024 email sending requirements for Google and Yahoo are causing a lot of concern among email senders, but they needn’t. In fact, the odds are good that you are already doing everything that you need to, or, if you aren’t, you already know that you should be. The bottom line is that the general requirements are simply: Have proper authentication set up (SPF, DKIM, and DMARC – yes, all three), have the required one-click unsubscribe link in your headers in all of your bulk email, and keep your spam complaint rate down in the negligible zone (more on that later).

Don't forget that in just a few months, starting in February 2024, both Google (Gmail, etc.) and Yahoo will require that you have DMARC authentication in place, and a DMARC policy selected. While this applies to senders who send more than 5000 emails a day, it's wise to have this in place even if you send fewer emails per day. Here is our handy, plain English quick-reference guide to DMARC policies! Feel free to save and share!

How to Turn Your Email Into a Money Making Machine
There are three things that have to happen in order for the email you send to make money for you:
1. Your email has to be seen
2. Your email has to tell a compelling story
3. Your email has to lead them to your offer
1. Your email has to be seen: It is critical that your email goes into the inbox, instead of going to the spam folder or being blocked. Be sure that your SPF, DKIM, and DMARC are set up correctly, pay attention to your text:image and text:code ratio, limit the number of links, and be sure to remove dead email addresses in a timely manner.
2. Your email has to tell a compelling story: The content of your email should draw people in and engage them. Remember that you are talking to individuals, so write to them as if you are writing to a friend, and tell them a story. Provide nothing but value in 3 out of 4 emails that you send; the 4th one is where to ask for the sale, which brings us to...
3. Your email has to lead them to your offer: The value you have been offering in each of your emails, and the story you have been telling, is what builds up to your offer, and is what causes leads to become customers, customers to become repeat customers, and repeat customers to become raving fans. Give them a roadmap to get there.

If you have the feeling that bot clicks seem to be an increasing problem in the email marketing world, well, you’re not alone. Email bots, also referred to as server bots, are automated systems which click on the links contained in email. Whether there has been a dramatic increase in actual bot clicks, or just in the awareness of them, they are definitely a thing.

We are often asked how to report spam. The flip side of what we do here at Get to the Inbox by SuretyMail, which is certifying good senders, is nuking bad senders, i.e. spammers. Here is how to report spam to both the source host (in other words the platform that is hosting the spammer and through which they are sending their spam) and the platform hosting the website advertised in the spam.

Micfo CEO Amir Golestan has been sentenced to prison for five years for using made-up people and fake email addresses in order to amass more than 735,000 IP addresses which he then sold to spammers and scammers in China, Saudi Arabia, and elsewhere, along with a smattering of actual legitimate customers. The actual crime of which he is convicted is wire fraud, however for our purposes it is the subject of that fraud, the acts and deeds which led to the fraud charges, which are interesting. Our CEO @annepmitchell isn't always subtle; she just posted this on LinkedIn in response to @Mailtrackio spamming us:
WOW. Just...wow. Mailtrack, Nichelle Antoque Lucero 🌸, Eduardo Manchón could your spam targetting be any worse?? You seriously just *spammed* a company run by an anti-spam attorney, the company that affects email sender reputation ... for your email product?? Just how stupid are you?? Oh wait, more stupid than that, because you're based in a country covered by GDPR! So, we'll be reporting you to your Agencia Española de Protección de Datos - AEPD immediately following this posting.

Do you or a client send out legally mandated emails, such as notices of class action lawsuits, notices of changes to terms, or anything else that is legally required to be emailed out? If so, then you will be interested to know that we recently added two new sender reputation data codes to our SuretyMail email senders reputation certification service: "Email from this IP address consists entirely of communications that are required by law" and "Email from this IP address consists entirely of communications that have been ordered by a court of law such as public notice of service or notifications of class action lawsuits to members of the class".
As you may know, our reputation system is relied on by inbox providers and spam filters around the world, so if either of the above describes you or your client, let us know if you'd like more information at [email protected]

UK Email Marketing Consent Requirements and How to Report Spam Under the UK GDPR
Many people don’t realize that when Brexit happened the United Kingdom (“UK”) adopted their own version of GDPR, often referred to as the UK GDPR. When it comes to email marketing in the UK, the UK Information Commissioner’s Office (ICO) has made fairly explicitly clear that under the UK GDPR there are only two situations in which you can send someone email marketing: you must either have their prior consent, or they must be an existing customer (this is the so-called “soft opt-in”). Here are the actual rules, as well as how to report email originating in the UK which violates these rules.

How Gmail, Yahoo, and Microsoft Deactivating Old Accounts Will Hurt Your Deliverability
Google has started sending notices of deactivating inactive Gmail addresses (actually they are going to deactivate dormant Google accounts, which includes Gmail accounts); and Yahoo posted a notice about deleting inactive mailboxes earlier this year. Microsoft has had such a policy for years. And if you don’t pay attention to this it can, and likely will, hurt your deliverability.

❗️We are receiving a growing number of tickets because of this issue: There seems to be something affecting the latency at which @Microsoft365 is currently ingesting changes in Spamhaus' data.
We're trying to engage with the relevant contacts at Microsoft to have the issue remediated. We'll provide an update when we know more.

The Legitimate Interest Test and How it Applies to preGDPR Data
There is a lot of confusion over what exactly qualifies as “legitimate interest” under GDPR. Additionally, you may be wondering whether GDPR governs the handling of personal data which you collected before GDPR went into effect and, if so, whether you can keep it under the legitimate interest test. The answer is both ‘yes’ and ‘no’. Here we talk about the legitimate interest test generally, and how it applies to data acquired before GDPR went into effect. We also include information about how to obtain the model legitimate interest assessment (LIA) template which has been developed by a GDPR expert and which we have been given permission to share.

Warming Up an IP Address: A Story in 3 Parts
You should never send mass or bulk email through a new IP address before you warm up that new IP address. Warming up an IP address is a critical step towards not only having good deliverability, but also to making sure that your email isn’t tagged as spam, or blocked. To illustrate the importance of warming up an IP address, we’re going to tell you a story in three parts.
