But the picture going around of the kid with his hands clearly up is a picture from after the shit was already fired. If you watch the video in slow motion and see when the shit was fired he had not clearly put his hands up at the time.

They have no benefit of the doubt. And yes, the gun had been dropped while the officer was in the act of shooting. Officer clearly didn’t have time to see it dropped.
