I saw @MarkGerretsen's insane tweet defaming @KatKanada_TM as being in the pay of Vladimir Putin, and I saw her statement that she intends to sue him for defamation.

Here's why I think Gerretsen is actually in some real trouble:

1. It's factually false.

Defamation law protects a wide range of opinions, including extreme opinions, but Gerretsen's defamation was stated as a fact, not an opinion: "a foreign government paying you to engage with me".

That's either true or false; it's not a matter of opinion. It's astonishing that Gerretsen would say something so damaging with no evidence. It's disinformation and fake news and because it's targeting an individual, it's defamation.

2. No fact-checking

Gerrestsen didn't attempt to check his facts -- such as emailing Kat with any questions. Had he done so, he might have been able to argue the "responsible communications" defence to defamation, claiming he took reasonable steps to find the truth. Obviously he didn't: he just made it up. He clearly wanted to publish his accusation precisely because it wasn't true.

Worse, he turned off Twitter "replies", so that no-one (including Kat herself) could correct his tweet underneath it.

Why would someone do that, unless their goal was to unfairly hide the other side of the story? A judge will want to know.

3. Prominence and audience

Gerretsen is routinely mocked as a clown on Twitter, but that doesn't change the fact that he is a powerful man who is part of the government. What he says is more authoritative than what a low-status, anonymous person would say. That makes a defamatory statement more damaging.

Gerretsen has 34,400 followers which isn't particularly large, but it includes a high density of VIPs -- other journalists, politicians, business people, etc. The tweet, at this moment, has 153,300 impressions, which is quite large and growing. Gerretsen seems to be relishing the attention, and is replying to himself repeatedly to make the defamation go viral.

Each new viewer is more damages.

4. Government authority

Gerretsen's Twitter account has the grey "government" checkmark, which implies authority and accuracy. Indeed, Gerretsen routinely denounces his critics as liars, implying that what he himself says is accurate and official. What's more, in his defamatory tweet he threatens to use his government power to punish Kat: "this person needs to be brought before committee to answer questions."

This isn't just in the realm of defamation now; it's also misfeasance in public office and abuse of process. Those are torts in and of themselves, but they also exacerbate the tort of defamation, since they imply Kat needs to go through some sort of McCarthyist hearing, she's on that level of odium.

Politicians can't use the power of the state to settle personal grudges against private citizens. Sounds like no-one has ever told him that, but a judge probably will.

5. Malice

Malice is deadly in defamation law -- if your statements were motivated by ill-will, you can lose various defences, such as fair comment. Gerretsen is one of Trudeau's most loyal attack dogs who seems to say literally anything handed to him on a piece of paper. His track record of quarrelling with Kat in the past suggests this was a vendetta, not a genuine tweet motivated by good faith in the public interest. I bet he's tempted to scrub his timeline of past interactions with Kat, but that would only make things worse -- a judge would see that as tricky, an attempt to hide things from the court.

6. Damages

Kat is Russian by ethnicity. An accusation that she is in league with Putin, a foreign dictator, is devastating. It implies she has divided loyalties and cannot be relied upon for honest journalism or activism. It paints her as an illegal foreign agent (although the Liberals are never this cruel to actual foreign agents, including their own caucus members). It's anethnic attack, not just a political attack.

Gerretsen is trying to destroy her reputation not only amongst the general public, but also in the industries in which she works. And unfortunately I think it's going to have some effect. Just look at the replies, doubling down on Gerretsen's original lies.

7. Private records

In a lawsuit, each party must disclose relevant documents in their possession such as emails, Twitter DMs, etc. If Kat didn't take any payment to appear on the show in question, that should be easy to prove, and in defamation, the defamer has to prove the truth of his smear, not the other way around. I can't imagine Kat would have a lot of records at all about this.

Gerretsen, by contrast, would have to disclose anything touching on Kat and the defamatory tweet -- including his private messages, emails, texts, DMs, etc. about it; any instructions given to him by the PMO; any private banter with other MPs or Senators, including where he shows malice and derogatory remarks. And you just know that an idiot like Gerretsen has said derogatory remarks.

8. What happens next

I think Gerretsen is used to the freedom of the House of Commons, where you can't be sued for defamation, no matter what you say. And on Twitter, he's usually just stupid, not defamatory.

This is a whole new world he's about to enter, and simply deleting a tweet won't be enough to fix it.

Of course he'll get a free lawyer courtesy of taxpayers. But that won't change the fact that he'll have to disclose all of his records and explain why he simply made up facts -- when he claims to be against fake news.

I think his threat to subpoena Kat is dead in the water -- he wouldn't dare go through with such an abusive stunt with litigation afoot.

I think he's caught himself in a trap. I'd say he's about to be embarrassed in a very meticulous and tenacious way, but then again, I'm not sure if Gerretsen even gets embarrassed. And as I said before, taxpayers will pay for his lawyers.

Anyways, those are my thoughts.

9. Personal anecdote

I have been sitting here for 20 minutes, thinking of how to respond to this video. It’s the most mind-blowing act of desperate, defamatory hate-mongering imaginable. There literally are no depths to which this POS scumbag @JustinTrudeau will not sink.

My first thought was to tell him to go fuck himself. But that would be too easy and devoid of substance.

My second thought was to point out the hypocrisy of this black-face wearing, woman-groping, ethics-breaching, Nazi-worshipping POS accusing others of “extremism”. But he knows this. It’s the essence of his provocation. He is the piece of shit he accuses others of being. Everyone knows it. He portrays himself as the hero while provoking the victims of his abuse.

My third thought was to remind him - no, to reassure him that - that he will go down as the biggest stain in the history of Canada. But I don’t think he cares. He has betrayed Canada and Canadians for his 30 pieces of silver.

Ultimately, there is only one thing to say: Trudeau may never face any meaningful or commensurate form of justice for his persistent, repeated evil conduct. But he will live the rest of his days with the greatest curse imaginable: to be so detested and so detestable that he cannot even walk among the people. He will live the rest of his days in a prison of his own making. A prison of his own pride. Knowing that no one will shed a tear when his time on this earth is done.

Contrast that to James Topp, a man Trudeau can only aspire to be in his wildest fantasies. A veteran. A brave soul. A man who literally walked across the country among his brethren to protest the abuse. A man who loves and who is loved. A man of whom Trudeau is so rabidly jealous, he feels compelled to use his governmental powers to defame and destroy.

🔥🔥Must watch questioning of the Justice Minister about the federal government’s decision to appeal the Emergencies Act federal court decision.

Did you find it strange that immediately following the release of the court's decision, Deputy Prime Minister Freehand announced the government's intention to appeal?

Justice Mosely’s decision was a significant one. If outlined how the federal government failed to justify the invocation of the Emergencies Act due to lack of evidence and how the measures implemented breached Canadians' Charter rights. The decision was not only well-reasoned but also a huge political embarrassment for the federal government.

So when DPM Freehand rushed before the cameras to make her intentions known about appealing the decision, the question arises whether the decision to appeal was based on legitimate legal reasons or was it a political move to save face?

The use of taxpayers' funds to appeal a decision that exposed the government's failures and illegal actions is a matter that warrants scrutiny. Canadians deserve to know whether the appeal is truly in the best interest of justice and the Canadian people or if it is just about political optics.

Further, the role of the media in framing and prioritizing the announcement of the appeal is important to address. While the announcement of the government's intent to appeal was prominently covered by the legacy media, the deeper implications of the court's ruling were overlooked or downplayed. The federal court found that the federal government acted illegally. Canadians deserve to be fully informed about how their government erred and acted unlawfully, rather than having the narrative possibly manipulated or obscured.

Finally and most importantly, if a Prime Minister and elected representatives had any integrity, they would have resigned. However, they chose not to do so and instead engaged in grandstanding and dividing their own citizens. Canada deserves better.
