The person who tested positive is not at risk of having criminal prosecution. Adults take responsibility for their actions and behavior. These are part of the principles of responsible marijuana use.

Pot smokers everywhere know scapegoating when they see it. For years we were said to be lazy and didn't want to get off the coach and make something of ourselves. These were all BS narratives pushed by the culture warriors who feared their children making their own decisions.
