Dear Americans,
The employment based immigration quota in the United State is 140,000/year fixed. @TravelGov publishes an openly discriminatory document called 'visa bulletin' which determines who gets these permanent residencies. Let's see if you understand this document and can determine who will get the permanent residency first out of these four scenarios, based on the July 2023 visa bulletin.
Note: Mexico means for people who are born in Mexico, not Mexican citizens.
Scenario 1: An Indian guy, who was born in India, who came to the United States to study after high school. Went through four years of pre-med, four years of medicine school, and finished 8 years of internship and residency to become a neurosurgeon. By the time he files his immigration petition, he has already lived in the United States for 16 years, obeyed all the laws, and has paid thousands of dollars in taxes over the years. Because of his qualification and articles he published over the years, his immigration petition gets approved in August 2022 in the 1st category.
Scenario 2: For this scenario you can take any country other than whose name you don't see in the picture but for an example, let's use Pakistan. A guy from Pakistan, who was born in Pakistan, who did four years of Bachelors in Computer Science at a local university. He got a job at a local software company and worked there for one year. He applied to a US based software firm and got recruited. The guy has never been to the United States before and hasn't paid any taxes to the United States yet. The US based software firm files immigration petition for this guy and it gets approved in April 2023 in the 3rd category.
Scenario 3: An Irish girl, who was born in India during two years her parents were on a business trip. She came to the United States from Ireland for her studies after finishing her high-school in Ireland. She finished her undergrad, grad and doctorate studies in the United States and is now doing critical research related to cancer immunology. By the time she files her immigration petition, she has already lived in the United States for 13 years, followed all the laws and paid thousands of dollars in taxes over the years. Because of her qualification and research articles she published her immigration petition gets approved in November 2022 in the 1st category.
Scenario 4: A guy and girl, both from India and born in India, come to the United States for masters in Cybersecurity. After finishing their studies, they get a job at a leading cloud provider where they are responsible for securing data all the Federal agencies like FBI, NSA are storing at this cloud provider. After working for 2 years, this company filed their immigration petition which got approved in 2nd category in November 2012. They both get married. They saved and made a lot of wise financial investments over the years from their salary. In 2020, they decided to start their own business and apply for permanent residency in the 5th Unreserved category. Requirements of this category is to invest at least 1 million dollars and create 10 full-time jobs. They actually invested 1.1 million dollars and created 15 full-time jobs. Their another immigration petition gets approved in May 2020 in the 5th Unreserved category.
In summary, by July 2023, this couple had lived in the United States for 15 years, followed all the laws, paid thousands of dollars in taxes, invested more than a million dollars they saved after paying taxes, created 15 full-time jobs and had not one but two immigration petitions approved. One in 2nd category approved in November 2012 and another in 5th Unreserved category approved in May 2020.
