Pour expliquer simplement, un entrepreneur apporte les titres de son entreprise à une holding. La plus-value constatée est placée en report d’imposition. S’il revend les titres dans les trois ans, il doit réinvestir au moins 70 % du prix de cession dans l’économie pour conserver ce report. Il immobilise donc son argent. Il finance des entreprises. Il accepte de prendre de nouveaux risques. Il respecte scrupuleusement toutes les règles imposées par l’État. Puis l’État change subitement les règles après la partie. C’est exactement ce qui se passe avec le projet de loi de finances pour 2027, qui prévoit que, pour les apports réalisés depuis le 14 novembre 2012, la donation ou la succession ne purgerait plus la plus-value en report. Les héritiers ou donataires pourraient donc devoir payer à la fois les droits de mutation à titre gratuit et l’impôt sur la plus-value. Le cumul pourrait atteindre 66,23 %. Je ne sais pas si on mesure la dinguerie. À ce niveau, c’est de la spoliation en bonne et due forme. La définition de l’impôt confiscatoire par excellence. Imaginons : un entrepreneur crée une entreprise, travaille pendant des années, paie ses impôts, prend tous les risques, réinvestit jusqu’à 70 % du prix de cession dans l’économie, respecte la loi, puis transmet ce qu’il reste à ses enfants.
