The JCCF says it has begun hearing from Canadians who have been visited at home by government officials and charged over historical online posts following the implementation of Bill C-9, the “Combating Hate Act.” Many of those arrested now potentially face years in prison for sharing wrongthink on social media, even if the posts were made before the law came into force. The legislation received royal assent on June 18 and officially took effect on July 18. Civil liberties advocates warn the law marks one of the most aggressive crackdowns on free speech in Canada’s modern history. Canadians Reportedly Targeted Over Years-Old Posts The JCCF says people are now being visited at their homes by authorities over content they shared online long before the law came into force. “We are receiving reports that some Canadians are being contacted at their homes by government officials about social media posts made months or even years ago,” the legal advocacy group said. “These reports come after the passage of Bill C-9, the Combatting Hate Act, which expands Canada’s hate speech laws by creating new offences, increasing penalties, and removing certain legal safeguards that previously limited prosecutions for hate-related expression.” The organization warned that the legislation significantly broadens the government’s ability to pursue criminal charges for speech it deems hateful. New Law Expands ‘Hate Crime’ Powers Bill C-9 creates new standalone hate-related offenses and introduces additional criminal charges for intimidating or obstructing people at places of worship, schools, and community centers. It also criminalizes the public display of symbols associated with listed terrorist organizations, two different types of Nazi symbols, and a noose. But critics say the most controversial aspect of the legislation is the sweeping expansion of Canada’s hate speech laws. According to the JCCF, prison sentences have been substantially increased. The group says maximum penalties rise from two years to five years for lesser offenses, from five years to ten years for “more serious crimes,” while the most severe hate-motivated offenses can now carry life imprisonment. The law defines hatred as “an emotion of an intense and extreme nature that is clearly associated with vilification and detestation.” Whether a social media post meets that threshold will ultimately be determined by police and prosecutors. Religious Speech Loses Longstanding Protection The legislation also removes a longstanding legal safeguard that previously protected religious expression made in good faith. Under the former Criminal Code provision, individuals could avoid conviction for expressing, in good faith, opinions on religious subjects or views based on religious texts. However, Christians could now be charged with “hate crimes” for quoting Bible passages under the new law. JCCF lawyer Hatim Kheir said removing that protection fundamentally changes how such cases will be handled. “Bill C-9 will directly impact investigation and prosecution decisions concerning religious expression which possibly could have been viewed as good faith expression based on a religious text,” he said. Another significant change removes the requirement for prosecutors to obtain the attorney general’s consent before filing hate speech charges. Justice Minister Sean Fraser defended the move by arguing it would allow authorities to move faster. “By removing this step, law enforcement would be able to act quickly,” Fraser said. Free Speech Advocates Warn of Government Overreach The reports have intensified concerns that Canada is moving toward criminalizing political, religious, and cultural opinions expressed online.
