@unusual_whales Well if you can short a stock and never have to repurchase your liabilities (as shown in #mmtlp) you short at any price level. They don’t care if it’s high or low they just never repurchase it. MMTLP is a disgusting example of what’s going on.

BREAKING: Hedge funds are betting against stocks at near-record levels, per Goldman Sachs.
Short sales outpaced purchases by about 5 to 1 across global stocks.
Short positions on Goldman’s books are at the 99th percentile of the past five years.

May I remind everyone that brokers themselves raised on-loan shares in the FIF meetings back in 2023. These questions have been under discussion for years. So how were the new S1 @nbhydrocarbons dividend obligations tied to those positions fulfilled?
Greg McCabe has said brokers are oversold. NBH reportedly says no additional shares were purchased from the company. If brokers increased customer balances through accounting entries, what corresponding shares did they receive? Were actual NBH shares delivered or were accounts credited with claims to shares still owed?
Publish the reconciliation: shares received, customer balances credited, outstanding lending and dividend obligations, and any unresolved shortfall. An accounting entry alone does not establish delivery. If undelivered claims were knowingly represented as delivered shares, that warrants investigation.
SEC Rule 15c3-3, the Customer Protection Rule, generally requires brokers to maintain possession or control of fully paid customer securities.
FINRA Rule 4330 governs the use and lending of customer securities, including applicable consent, disclosure and borrowing requirements.
If brokers are relying on a lending arrangement or exception, identify it and demonstrate compliance.
What happened to borrowing fees on outstanding loans? Are they still being assessed and collected? If they stopped, explain when, why and under what contractual authority.
Who remains responsible for returning securities and satisfying the associated dividend obligations?
The released FINRA email also references prior calls before its public MMTLP statement. Who participated, what was discussed and what role did industry input play in the regulatory response? Regulators should exercise independent judgment and shareholders deserve transparency about how their interests were represented.
NBH says it has requested an open forum at least seven times. @SECGov @SECPaulSAtkins will you meet with Greg McCabe and bring the relevant parties to the table?
With Greg appearing on @cvpayne @FoxBusiness program, I hope Charles asks what NBH’s records establish, what information remains missing and what is preventing a coordinated reconciliation.
NBH, its transfer agent, regulators and the relevant brokers and clearing firms should participate with DTCC contributing wherever relevant records exist. Protect confidential customer information while publishing aggregate findings, outstanding obligations, and a timeline for resolution.
It is now 2026. When is enough, enough?
FOIA disclosures and other emerging data points warrant meaningful oversight and follow-up. As more information comes to light, the need for documented answers only grows.
It is time for all parties to get together, reconcile the records, address any outstanding obligations and establish a resolution so the company and its shareholders can finally move forward.
