When ADOR manufactured 3.5 million copies of NewJeans' Get Up, they incurred two types of costs: variable costs (like the physical paper, plastic, and ink per album) and fixed costs (like studio production, design, photography, overhead, and factory setup fees). ​Fixed costs stay the same whether you print 1 album or 3.5 million albums. By overproducing, ADOR triggered the "allocation effect": ➖️​Scenario A (Produce what you need): If you spend $1,000,000 in fixed costs and print 1 million albums, each album carries $1.00 of fixed cost. If you sell them all, your expense is $1,000,000. ➖️​Scenario B (Massive overproduction): If you spend that same $1,000,000 but print 3.5 million albums, each album now only carries $0.28 of fixed cost. Which make looks like for that year, ADOR spent less with fixed costs. And profit went up. ​If 1.61 million albums go unsold and sit in a warehouse, the $450,000 of fixed costs tied to those unsold albums gets pushed into the future as an asset. It is not counted as an expense for 2023. 🔹️🗣​The Result: ADOR successfully hid a massive chunk of their 2023 expenses inside the unsold inventory sitting in the warehouse.

Belift Lab requested a document production order, and the court served a written inquiry on Shin Dong-hoon, a former ADOR vice president who owns 1% of ADOR, regarding his KakaoTalk conversations with Min Hee-jin. This is not necessarily a final submission order yet, but it also does not mean submission is purely voluntary. Park said his remark was not intended as a literal assessment of Ador’s value, but rather as an attempt to ease tensions with the head of a disgruntled subsidiary during negotiations. He added that Min’s demand for a 30 times multiple was effectively equivalent to asking for the company’s entire profits, making it impossible for HYBE to accept. “I did not realize she would try to pressure the company into a low-price sale” The court also pointed to the fact that HYBE leadership did not respond immediately after learning that Min had been in contact with outside investors. Park explained that when he first heard the allegation in February 2024, through outside director Park Young-ho, he found it difficult to believe. Given what he described as HYBE’s unprecedented level of support for Min, he said the idea that she was pursuing a management takeover seemed implausible at the time. He said his response, “then let her try”, reflected his view that as long as HYBE, as the controlling shareholder, did not sell its stake, there was little she could actually do. Park said he had not yet realized that she might try to damage HYBE’s reputation or otherwise put the company in a position that could lead to a low-priced sale of its stake in Ador. He said he immediately shared his chat records with Min with the legal team and instructed them to verify the facts. According to Park, suspicion gradually turned into certainty as Min met with outside investors, spoke negatively about HYBE, and later, in April, used the parents of artists to send what he described as unreasonable protest emails. He also said that documents uncovered during the internal investigation, including one titled Project 1945, suggested that coordinated public attacks on artists from other HYBE labels had been part of the plan. “The ‘album-pushing’ allegation is a misleading narrative used to attack HYBE” Park also firmly rejected the “album-pushing” allegation mentioned in the ruling. He said the term itself had never been clearly defined and that its meaning shifted over the course of the dispute to suit Min’s claims. The court had relied in part on KakaoTalk messages between Min and Ador’s then-deputy CEO. In those messages, the deputy relayed that Park had expressed concern that NewJeans’ Get Up album was not selling as well as expected and had suggested encouraging greater purchases of Korean albums in Japan. Park said this was simply a normal inventory-management proposal. According to him, there had been a mismatch between projected demand and actual sales, resulting in excess inventory, and he was suggesting a standard marketing response to help move stock. He added that Min herself had used similar methods in the past, citing a case in which 150,000 albums were sold to a Japanese distributor and fan-sign events were later held to help clear the remaining inventory.
