Flaws in Dereservation Policies Proposed in UGC Guidelines dated November 2023

The major flaws in this are explained in detail
1. As per the DOPT OM dated November 6, 2003, para 2, it is very clear that the exchange of reservations between SCs and STs is not permitted. It is very clear that each group (General, SC, ST, and OBC) is a distinct category, and the exchange of seats, even among reserved seats, is not permissible.
2. As per Paragraph 3 of the above OM dated November 6, 2003, the procedure for filling up reserved vacancies has been laid down. In the case of direct recruitment, there is a complete ban on dereservation, and the same is reproduced below.
“ (i) Where a sufficient number of candidates belonging to SC, ST, or OBC are not available to fill up the vacancies reserved for them in direct recruitment, the vacancies shall not be filled by candidates not belonging to these communities. In other words, there is a ban on dereservation of vacancies reserved for SC, ST, and OBCs in direct recruitment.
"
3. Again, paragraph 3 of the above OM dated November 6, 2023, clearly explains how the vacancies called “backlog vacancies” are created. Now, even if the vacancies reserved for SC, ST, and OBCs do not get filled up, they are carried forward as backlog vacancies and would be carried forward as long as backlog vacancies were filled. So, there is no question of dereservation of reserved seats in case these seats have to be filled up.
4. However, Paragraph 3(v) of the above OM states that only in rare and exceptional cases in Group A services, where the posts cannot remain vacant, can they be deserved in the public interest.
However, such action must be taken only with the consultation of the National SC/ST Commission or the National OBC Commission. The next step is that these comments should be placed before the Ministry of Social Justice and then finally in front of the concerned minister.
This is where the UGC guideline dated November 2023 is problematic. DOPT bars the dereservation of Group B/C/D posts in cases of direct recruitment.
But the UGC guidelines state the following:
"10.2 The proposal for de-reservation in the case of Group ‘C’ or ‘D’ should go to the Executive Council of the University, and in the case of Group ‘A’ or 'B', it should be submitted to the Ministry of Education, giving full details, for necessary approval. After receiving the approval, the post may be filled, and the reservation may be carried forward."
So, it is clear from the above guidelines that the proposal for dereservation can happen in Group B/C/D posts too.
The DOPT circular states that it should first go through the National Commission for SC/ST/OBCs, then the Ministry of Social Welfare, and finally the minister. However, notice that this reference only refers to the executive council of the university or the Ministry of Education. This bypassing of the National Commission of SC/ST/OBCs is completely wrong.
In the case of Mandeep Kumar vs. UT Chandigarh (Civil Appeal No. 1908 of 2022) the Apex Court also discussed the issue. It was held that the request should have the approval of the Department of Welfare of SC and Backward Classes for dereservation. Not having the same would violate the procedures laid down, and hence the dereservation process was held to be null and void.
The extracts of the order is reproduced below for everyone’s benefit
"It is clear that as per Section 7 of 2006 Act, dereservation for the reserved vacancy by the appointing authority is restricted. The said dereservation may be possibly directed by the Department of Welfare of Scheduled Castes and Backward Classes if it is expedient in public interest after recording satisfaction for such dereservation. In the said contingency the department shall pass an order assigning those reasons. Thus, in the context of 2006 Act also the dereservation or interchangeability may be possible with a rigour to exercise such power by the department, namely; Department of Scheduled Castes and Backward Classes and not appointing authority,"
So para 10.2 in the UGC guidelines dated November 2023 violates DOPT OM dated November 6, 2003.
5. In the case of dereservation in the case of promotion, it is very interesting to see that the word “OBC” does not appear in the DOPT OM dated November 6, 2003.
This is because for OBCs, there are no reservations in promotions.
So clearly, per para 3(B), the guidelines in the case of dereservation are applicable only to SC/ST, and in the case of OBC, they cannot be considered.
So, whenever promotion happens from Group C to Group B and from Group B to the lowest rung of Group A, the OBCs have no safeguards.
However, even in the case of SC/ST, it is very evident that if enough SC/ST candidates fit for promotion are not found against reserved vacancies, the same should be considered backlog vacancies and will be carried forward till the end.
Now the prescribed procedure for dereservation again requires vetting by the National Commission for SC/ST and even the Ministry of Social Welfare. However, if one sees the UGC guidelines, the power to dereserve seats is delegated to the UGC, Ministry of Education, with the approval of the liaison officer for SC/ST.
This is a very weak mechanism, and usually liaison officers for SC/ST are yes-men and don’t want to carry out professional due diligence on any proposals.
By diluting the procedure prescribed in the DOPT OM dated November 6, 2003, it appears that the path for easier dereservation is made easier, which is against the judgments laid down.
6. The problem at central universities is again because of the roster system. Most of the central universities follow a 13-point roster and not 100-point or 200-point rosters, because of which the mischief of dereservation gets amplified.
Para 4 gives how, in the case of more than 13 posts that do not follow the 13-point roster, it is almost impossible for the reserved posts to expire.
The extracts are reproduced below.
"In cadres having more than 13 posts, number of posts filled by reservation by any category at any point of time should ideally be equal to the quota determined as per percentage of reservation prescribed for that category. Whenever the posts are filled, efforts have to be made to complete reservation quota for SCs/STs/OBCs in case of direct recruitment and for SCs/STs in case of promotion so that the number of posts filled by reservation by SCs, STs and OBCs, as the cases may be, in the cadre is equal to the number of posts earmarked for them. It means that if reservation quota is not complete, efforts would be made to complete the reservation quota whenever the recruitments are made in the cadre. Thus, reservation would not lapse in case of post-based reservations for the reason that reserved posts could not be filled for a specified number of years."
Clearly, in the case of a 100-point roster or a 200-point roster, there are no issues with dereservation.
7. However, most of the central universities follow a 13-point roster, and dereservation can create serious issues. For that, one needs to look at Paragraph 5 of the DOPT OM
"In cadres having 13 or less number of posts where 14 point L-shaped rosters are applied, if a reserved vacancy is filled by a candidate belonging to other community after dereservation, the reservation will be carried forward for subsequent recruitment year. Such carry forward of reservation would be permitted for three subsequent recruitment years. In the third year of carried forward of reservation, the vacancy will be treated as reserved for the concerned category, but if it cannot be filled by reservation in the third year of carried forward of reservation by a candidate of the concerned category, reservation will be treated as lapsed and it will be filled as an unreserved vacancy."
In this case, the carryforward of backlog vacancies happens only for three years, while in a non-13-point roster, it can be carried forward for any number of years. In the third year of carrying forward a reservation, the reservation will be treated as lapsed and filled as an unreserved vacancy.
This is the problem of having dereservation and 13-point roster working together.
These are some of the main reasons why, even today, the representation of SC/ST/OBCs in Central Universities is dismal.
Dereservation guidelines issued by UGC need a revisit. I request a few prominent members of the UGC board from SC, ST, and OBCs to take up this issue urgently.
