A #Massachusetts ruling overturning #LatarshaSanders’ conviction spotlights how mental health evidence and jury composition shaped two child-killing cases involving mothers of different races. https://t.co/cLf3C5d5YQ

Way too many of y’all are conflating intentional physical behavior w/a legally responsible mind, & it’s truly bizarre.
Someone can perform purposeful, organized actions while severely mentally ill.

#LatarshaSanders, who was sentenced to life without parole for killing her two young sons, has been granted a new trial after Massachusetts' highest court ruled that jurors were improperly prevented from hearing evidence about her mental health.

Just to add some perspective to #Amerikkka's #CriminalJusticeSystem, check out the #LatarshaSanders case, which was tried by the same judge 👨⚖️ #WilliamSullivan. What he did differently in the #LindsayClancy trial is the reason 4 her new trial. He #Racist? https://t.co/1UbZISEVcA
Shrugs 🤷🏽♀️ But if a yt woman takes out her 3 children we must examine post partum depression&post partum psychosis. For #LatarshaSanders (Same exact judge as Lindsay Clancy btw) it's prison time. The 2 tiered justice system ⚖️ is ever present &more unequal than ever #JusticeForADOS

I thought judge sullivan was a fair, impartial judge and I want to still give him the benefit of the doubt, but after reading the way he handled the #LatarshaSanders trial & ruled her medical records as inadmissible…is crazy to me. so glad she got another trial. #lindsayclancy
People defend #LindsayClancy but stayed silent about #LatarshaSanders :
Latarsha Sanders was found guilty of first-degree murder (not NGRI) primarily because the jury rejected her insanity defense after key medical evidence of her severe mental illness was excluded from the trial, and the prosecution successfully framed her as “evil” and malingering rather than psychotic.
In February 2018 in Brockton, Massachusetts, Sanders (then in her 40s) fatally stabbed her sons Marlon (Edson) Brito, 8, and La’son Brito, 5, dozens of times in what she later described to police in delusional terms involving “voodoo,” “rituals,” “the bad people,” and efforts to “fix them up” afterward. She had been exhibiting escalating paranoia, conspiracy theories (e.g., Illuminati), and erratic/aggressive behavior in the preceding days. She was later diagnosed with schizophrenia (paranoid type) or related psychotic disorders that clinicians said had gone largely untreated for decades; a prosecution-hired forensic psychologist also found schizophrenia symptoms and that it was “highly likely” she was symptomatic around the time of the killings (though the Commonwealth did not call that expert).
Under Massachusetts law, a defendant is not criminally responsible (NGRI) if, due to mental disease or defect, they lacked substantial capacity to appreciate the wrongfulness of their conduct or to conform their conduct to the requirements of the law. The prosecution bears the burden of proving criminal responsibility beyond a reasonable doubt. A successful NGRI finding leads to commitment to a psychiatric facility (potentially long-term), not release.
At her 2022 Plymouth Superior Court trial, the defense (attorney Elliot Levine) presented a clinical neuropsychologist (Thomas Deters) who concluded after extensive evaluation that Sanders was in a “very severe psychotic state” and not criminally responsible. The prosecution (Assistant DA Amanda Fowle, under DA Timothy J. Cruz) offered no competing mental-health expert. Instead, Fowle argued Sanders was “evil,” “selfish,” and “playing the crazy card”; pointed to her post-killing statements/blaming of others, partial cleanup, and behavior as evidence she knew what she was doing; and cited a 2016 notebook entry about writing a book and money as purported motive for fame/profit. Graphic crime-scene evidence was emphasized.
Critically, the trial judge excluded substantial medical records (including prison and hospital diagnoses of schizophrenia-spectrum disorders, observations of hallucinations/paranoia, and treatment history) that the defense sought to introduce. Prosecutors successfully argued these were largely post-offense, involved hearsay, or were otherwise inadmissible/irrelevant. This left the jury without much of the documented clinical picture of her longstanding and acute illness. The jury deliberated roughly four hours and convicted her of two counts of first-degree murder (mandatory life without parole) plus witness intimidation.
Sanders’ current attorney has appealed to the Massachusetts Supreme Judicial Court, arguing the exclusion of the medical evidence violated her right to present a complete defense and that prosecutorial tactics (including character attacks, mischaracterizations, and speculation such as a “Law & Order” influence theory not in evidence) constituted misconduct

#LindsayClancy, #LatarshaSanders & #AndreaYates' lives will never be the same. Whether in jail or a mental hospital, there is no winning on either side. Instead, we should bring awareness to ensure history doesn't repeat itself instead of solely focusing on clickbait headlines.
