⚖️ In a recent judicial review of a refused #studypermit application for an Iranian national, Justice Diner outlined five reasons why the officer's decision was unjustified:
1. If visa officers rely on a factor as a #pushfactor, they must explain why it is of relevance in an applicant's particular circumstances.
2. The officer stated that the Applicant had no significant #familyties outside of Canada without mentioning that all of her immediate family members are well established and live in Iran. By not engaging with contrary evidence, the officer's finding on this factor was arbitrary.
3. The officer, in finding that the Applicant had previously studied at a higher level, did not engage with her submissions why the selected program would be of benefit. The officer did not explain why this element of the Applicant's study plan constituted "an inconsistent career progression."
4. While an officer can consider the availability of comparable programs and courses in an applicant's home country, the available alternatives "should be substantiated by the record." Here, the officer did not point to any comparable costs of programs in Iran. Instead, the officer's comments amounted to "career counseling" and focused on the "value of learning" to the Applicant.
5. The officer failed to comment on the Applicant's evidence of personal finances and support, including accommodation arrangements with her niece in Canada.
Overall, Justice Diner found that the officer's decision suffered from weaknesses including the use of #boilerplate statements that appear to have been generated by #Chinook.
