Modou Ceesay’s case is a clear case of UNFAIR DISMISSAL. It was unconstitution. Consequently the appointment of Modou’s successor was null & void because the position was technically not vacant. So the court can’t use his appointment to justify not reinstating Modou. #gambia #law

Gala Court ruling.

Principal Magistrate Sallah Mbye held that the police failed to prove a common nuisance against the GALA members at the National Auditor Office alleged protest.

She held that the police failed to produce a single person to establish that he/she was obstructed or the public was obstructed, or evidence of road blockage obstructing the motors movement.

She held that the prosecution has failed to establish a prima facie case and the no case to answer submission for the defence has stood.
