วันนี้ (28 กันยายน 2569) ศาลรัฐธรรมนูญมีวินิจฉัยว่า การจัดพิมพ์บาร์โค้ดและคิวอาร์โค้ดบนบัตรเลือกตั้งสมาชิกสภาผู้แทนราษฎร เมื่อวันที่ 8 กุมภาพันธ์ 2569 ไม่เป็นเหตุให้การเลือกตั้งครั้งดังกล่าวเป็นโมฆะ

ศาลให้เหตุผลว่า การพิมพ์บาร์โค้ดไม่อาจถือได้ว่า การใช้รหัสดังกล่าวทำให้การออกเสียงลงคะแนนไม่เป็นไปโดยลับตามรัฐธรรมนูญมาตรา 85

คำวินิจฉัยดังกล่าวทำให้การเลือกตั้ง ส.ส. วันที่ 8 กุมภาพันธ์ 2569 ไม่ถูกลบล้างจากประเด็นบาร์โค้ดและคิวอาร์โค้ดตามคำร้องนี้

ก่อนหน้านี้ ผู้ตรวจการแผ่นดินส่งคำร้องให้ศาลรัฐธรรมนูญพิจารณาว่า รหัสบนบัตรเลือกตั้งอาจใช้สืบย้อนถึงตัวผู้ลงคะแนนและผลการลงคะแนน จนกระทบหลักการลงคะแนนโดยลับหรือไม่ ศาลรับคำร้องไว้เมื่อวันที่ 18 มีนาคม และนัดอ่านคำวินิจฉัยในวันนี้
