मोदी सरकार की वन अधिकार अधिनियम की उपेक्षा से लाखों आदिवासी परिवार अपनी पारंपरिक ज़मीन से बेदखली के कगार पर हैं।

2006 में कांग्रेस ने ऐतिहासिक अन्याय को दूर करने और आदिवासियों को उनके जल, जंगल और ज़मीन पर अधिकार सुनिश्चित करने के लिए वन अधिकार अधिनियम (FRA) लागू किया था। लेकिन केंद्र सरकार की निष्क्रियता के चलते, इस कानून के तहत किए गए लाखों वास��तविक दावे बिना किसी समीक्षा के मनमाने ढंग से खारिज कर दिए गए।

2019 में सुप्रीम कोर्ट ने ऐसे सभी लोगों को उनकी ज़मीन से बेदखल करने का आदेश दिया जिनके दावे खारिज हो चुके थे, जिससे देशभर में भारी विरोध हुआ। इसके जवाब में कोर्ट ने बेदखली पर रोक लगाई और खारिज दावों की गहन समीक्षा का निर्देश दिया।

अब कल सुप्रीम कोर्ट में फिर से इस मामले की सुनवाई है — और एक बार फिर, मोदी सरकार लापता है। 2019 में भी वह इस कानून का बचाव नहीं कर सकी थी और आज भी आदिवासी अधिकारों के पक्ष में खड़ी नहीं दिख रही है। सबसे चिंताजनक बात यह है कि लाखों लंबित और खार���ज दावों की समीक्षा या पुनर्विचार के लिए अब तक कोई गंभीर प्रयास नहीं हुआ है।

अगर मोदी सरकार सच में आदिवासियों के अधिकारों की रक्षा करना चाहती है और लाखों परिवारों को बेदखली से बचाना चाहती है, तो उसे तुरंत कार्रवाई करनी चाहिए और अदालत में वन अधिकार अधिनियम का मजबूती से बचाव करना चाहिए।

Lakhs of Adivasi families face eviction from their traditional lands as the Modi government disregards the Forest Rights Act

The Congress brought the FRA in 2006 to correct a historic injustice, and to ensure that Adivasis have rights over their jal, jangal and zameen. However, *due to the inaction of the central government*, countless genuine claims under the FRA have been arbitrarily rejected without any review.

In 2019, the Supreme Court ordered the eviction of all those whose claims had been *rejected*, a move that triggered widespread protests across the country. In response, the Court paused evictions and called for a thorough review of the rejected claims.

Now, the case is back before the Supreme Court on April 2nd and once again, the Modi government is missing in action. It failed to defend the law in 2019 and continues to show no intention of standing up for Adivasi rights today. Worse still, there has been no serious attempt to review or reconsider the lakhs of pending and rejected claims.

If the Modi government truly wants to protect Adivasis rights and protect lakhs of families from eviction, it must act swiftly and defend the Forest Rights Act in court.
