The Washington Supreme Court has spoken on the issue. In short, if you've never taken the bar exam prior to this July, you can get diploma privilege, if you choose that option. I presume the reason they are giving this choice is that diploma privilege isn't portable, so even some entitled to it may forego it and take the September test. But it's available. If you've taken and not passed an exam prior to this July, you're out of luck as to diploma privilege. Your only option is to take September, if you don't want to wait till February. I suppose what the above implies is that we don't trust those who have previously taken and not passed the test to enter the profession without an exam. We'll take our chances on those who have not previously taken it! There's another part to the order which speaks to people who did complete the test, albeit with interruptions. (I didn't even know those people existed.) For those, they have no options. But if they don't pass the exam, they can get a free retake in February. A bar exam coupon of sorts. A bit complex, and slightly odd (to distinguish first-timers from non first-timers), but that's what we've got.
