Former Special Counsel Jack Smith testified under oath that the decision to prosecute Donald Trump was entirely evidence-driven, not political, and that the evidence met the “beyond a reasonable doubt” standard. He said Trump knowingly tried to overturn the 2020 election, obstructed the peaceful transfer of power, and willfully hoarded classified documents while blocking efforts to retrieve them. Smith rejected First Amendment defenses, emphasized that many key witnesses were Republicans and Trump allies, and said the violence on January 6 was foreseeable and exploited by Trump. In short: this wasn’t a partisan hit job, it was a straight-up prosecution based on mountains of evidence.
