1/ The opposition's ECI strategy is muddled. Everyone's chanting "Gyanesh Kumar must resign" — but that's a demand with almost no teeping power, and even less payoff if it works. 🧵
7/ Yet most opposition leaders are still stuck on the resignation slogan. It's louder, easier to chant at a rally — but it's the wrong target if the goal is actually changing how CECs get picked going forward.
(2/n)- CEC Gyanesh Kumar, along with ECs Sukhbir Singh Sandhu and Vivek Joshi, insisted the SIR order and schedules were approved unanimously by all three. The ECI clarified a letter sent to the Cabinet Secretary wasn't about Commission policy — but about an officer's deputation.
(1/n)- The ECI held its first press conference today (26 Sep 2026) since reports emerged of dissent among commissioners — two ECs had reportedly objected on record over a dozen times in 10 months to orders issued without their knowledge, per media reports.
2- In ADM Jabalpur (1976), the lone dissenting judge H.R. Khanna, who opposed the government, was later superseded too and resigned in protest.
In both cases, a junior was promoted over seniors who ruled against the government — breaking a decades-old judicial convention.
Two things everyone should know about India's judicial history
1- In Kesavananda Bharati (1973), judges who ruled against the govt — Shelat, Hegde, Grover — were superseded (passed over for CJI). A judge who sided with the govt, A.N. Ray, was promoted to Chief Justice instead.
